- Through the filing of briefs, pretrial motions, and the
- discovery process, a judge can gain a reasonable understanding
- of the approach to a trial that a particular attorney will take.
- It is not inappropriate for a judge to prohibit prejudicial
- behavior, nor is it inappropriate for a judge to order an
- officer of the court, as Scott pointed out, to not behave
- in a prejudicial fashion before the trial begins.
