  6. SHAREWARE LICENSE

  8. The shareware version of Internet Graphics Finder is provided at no 
  9. charge to the user for evaluation.  Feel free to share it with your 
  10. friends, but do not give it away altered or as part of another 
  11. system.

  13. If you find this program useful and continue to use it after 
  14. 30 days, you must make a registration payment to SkibbySoft 
  15. for the fee specified on the registration form found in the
  16. program's help file.  The fee will license one copy for use on 
  17. any one computer at any one time. The registration fee will allow
  18. the licensee to turn on any options that are disabled on the 
  19. shareware version.

  21. Anyone distributing the shareware version of this program for 
  22. any kind of remuneration must first contact SkibbySoft at the 
  23. address contained in the help file for authorization.

  26. REGISTERED LICENSE

  28. SkibbySoft licenses this single user software, Internet Graphics Finder, 
  29. to you, the first user, for use on any computer for which it was 
  30. designed.  This means we allow you to use the software on a single 
  31. machine at a single site at a single time.

  33. SkibbySoft additionally authorizes you to use a copy of Graphics
  34. Discovery on a secondary home or laptop computer, as long as this
  35. copy is never in use at the same time as the software copy which
  36. resides on your primary computer.  You must pay for additional
  37. copies of the software if more than one person will be using it at
  38. the same time.  You may not use it on a network unless all persons 
  39. who will access the software have an individual license.

  43. GOVERNING LAW

  45. This agreement shall be governed by the laws of the State of
  46. Washington.

  48. DISCLAIMER OF WARRANTY

  50. SkibbySoft warrants that for a period of ninety days from the 
  51. date of delivery of the licensed program, the program, if unmodified 
  52. by the Licensee, will perform in substantial conformity with the user 
  53. documentation.  SkibbySoft does not warrant that the licensed 
  54. program is free from coding errors.  Any modifications to the licensed 
  55. program shall thereafter be licensed AS IS.

  57. The above warranty does not apply to the extent that any failure of 
  58. the licensed program to perform as warranted is caused by the licensed 
  59. program being (1) not used in accordance with the user documentation, 
  60. or (2) modified by any person other than authorized SkibbySoft personnel.

  62. LICENSOR MAKES AND LICENSEE RECEIVES NO OTHER WARRANTY OF ANY KIND, 
  63. EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTIES 
  64. OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE.

  66. The total liability of SkibbySoft for any claim or damage 
  67. arising out of the use of the licensed program or otherwise related 
  68. to this license shall be limited to direct damages which shall not 
  69. exceed the license fee(s) which have been paid by Licensee to SkibbySoft 
  70. for the specific client project which is the subject of such 
  71. claim or damage.

  73. IN NO EVENT SHALL LICENSOR BE LIABLE TO LICENSEE FOR ADDITIONAL 
  74. DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL 
  75. OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO 
  76. USE THE LICENSED PROGRAM, EVEN IF LICENSOR HAS BEEN ADVISED OF THE 
  77. POSSIBILITY OF SUCH DAMAGES.

  79. IN NO EVENT SHALL LICENSOR BE RESPONSIBLE OR LIABLE TO LICENSEE FOR 
  80. OBJECTIONABLE MATERIAL OBTAINED THROUGH THE USE OF THE LICENSED PROGRAM.
  81. THE LICENSEE MUST ADHERE TO ALL COPYWRITE LAWS AND IMAGE USE RULES 
  82. SPECIFIC TO THE IMAGE SOURCE.
