  3. LICENSE INFORMATION

  5. ActiveMarks is Freeware from Applied Analytic Systems, Inc. 
  6. There are no license fees or  registration requirements for 
  7. users. 
  8.  
  9. ActiveMarks can be distributed freely on any bulletin board,
  10. file archive, or CD Rom without additional permission from, 
  11. or contact with Applied Analytic Systems. 
  12.  
  13. It is required, however, that any distribution of the program
  14. use the original archive file supplied by us, and that this
  15. file must be distributed intact, without modification.
  16.  
  17. [VERSION WARRANTY]

  19. Applied Analytic Systems warrants the physical diskette(s) 
  20. (if any) and physical documentation provided with registered 
  21. versions to be free of defects in materials and workmanship 
  22. for a period of ninety days from the date of registration.  
  23. If Applied Analytic Systems receives notification within the 
  24. warranty period of defects in materials or workmanship, and 
  25. such notification is determined to be correct, Applied Analytic 
  26. Systems will replace the defective diskette(s) or documentation.

  28. The entire and exclusive liability and remedy for breach of this 
  29. Limited Warranty shall be limited to replacement of defective 
  30. diskette(s) or documentation and shall not include or extend 
  31. to any claim for or right to recover any other damages, 
  32. including but not limited to, loss of profit, data, or use of 
  33. the software, or special, incidental, or consequential damages 
  34. or other similar claims, even if Applied Analytic Systems 
  35. has been specifically advised of the possibility of such 
  36. damages.  In no event will Applied Analytic Systems' liability 
  37. for any damages to you or any other person ever exceed the lower 
  38. of suggested list price or actual price paid for the license 
  39. to use the software, regardless of any form of the claim.

  41. APPLIED ANALYTIC SYSTEMS SPECIFICALLY DISCLAIMS ALL OTHER 
  42. WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, 
  43. ANY IMPLIED WARRANTY OF MERCHANTABILITY AND/OR FITNESS FOR A 
  44. PARTICULAR PURPOSE.

  48. This agreement shall be governed by the laws of the Commonwealth 
  49. of Pennsylvania, USA.
