  30. Executive summary:  it's a Federal felony for a normal person to
  31. pass within 1000 feet of any school property without all firearms
  32. unloaded _and_ locked in a container or locked in a gun rack.

  34. Having driven to and from a friend's hunting spot this year, I've
  35. begun to wonder:  can you get to anyplace in the country _without_
  36. passing within 1000 feet of a school, somewhere along the way?
  37. Country schools have to be bus-accessible.  They tend to be in or
  38. near small towns that are on main travel routes.  And 1000 feet
  39. is almost 1/5 of a mile.  Hmmm ...
  40.  
  41. Remember to lock those firearms while traveling, folks.

  57. #This is the actual text of the GUN FREE SCHOOL ZONES ACT OF 1990 from  
  58. #PUBLIC LAW 101-647 NOV. 29, 1990

  60. #SEC. 1702. GUN-FREE SCHOOL ZONES ACT OF 1990
  61. #  (a) SHORT TITLE.- This section may be cited as the "Gun Free School  
  62. #Zones Act of 1990".
  63. #  (b) PROHIBITIONS AGAINST POSSESSION OR DISCHARGE OF A FIREARM IN A  
  64. #SCHOOL ZONE.-
  65. #     (1) IN GENERAL.-Section 922 of title 18, United States Code, is  
  66. #amended by adding at the end the following new subsection:
  67. #  "(q)(1)(A) It shall be unlawful for any individual knowingly to possess  
  68. #a firearm at a place that the individual knows, or has reasonable cause to  
  69. #believe, is a school zone.
  70. #  "(B) Subparagraph (A) shall not apply to the possession of a firearm-
  71. #       "(i) on private property not part of school grounds;
  72. #       "(ii) if the individual possessing the firearm is licensed to do so  
  73. #by the State in which the school zone is located or a political  
  74. #subdivision of the State, and the law of the State or political  
  75. #subdivision requires that, before an individual obtain such a license, the  
  76. #law enforcement authorities of the State or political subdivision verify  
  77. #that the individual is qualified under law to receive the license;
  78. #        "(iii) which is-
  79. #             "(I) not loaded; and
  80. #             "(II) in a locked container, or a locked firearms rack which  
  81. #is on a motor vehicle;
  82. #        "(iv) by an individual for use in a program approved by a school  
  83. #in the school zone;
  84. #        "(v) by an individual in accordance with a contract entered into  
  85. #between a school in the school zone and the individual or an employer of  
  86. #the individual;
  87. #         "(vi) by a law enforcement officer acting in his or her official  
  88. #capacity; or
  89. #         "(vii) that is unloaded and is possessed by an individual while  
  90. #traversing school premises for the purpose of gaining access to public or  
  91. #private lands open to hunting, if the entry on school premises is  
  92. #authorized by school authorities.
  93. #   "(2)(A) Except as provided in subparagraph (B), it shall be unlawful  
  94. #for any person, knowingly or with reckless disregard for the safety of  
  95. #another, to discharge or attempt to discharge a firearm at a place that  
  96. #the person knows is a school zone.
  97. #       "(B) Subparagraph (A) shall not apply to discharge of a firearm-
  98. #            "(i) on private property not part of school grounds;
  99. #            "(ii) as part of a program approved by a school in the school  
  100. #zone, by and individual who is participating in the program;
  101. #            "(iii) by an individual in accordance with a contract entered  
  102. #into between a school in a school zone and the individual or an employer  
  103. #of the individual; or
  104. #             "(iv) by a law enforcement officer acting in his or her  
  105. #official capacity.
  106. #   "(3) Nothing in this subsection shall be construed as preempting or  
  107. #preventing a State or local government from enacting a statute  
  108. #establishing gun-free school zones as provided in this subsection.".
  109. #          (2) DEFINITIONS.- Section 921(a) of such title is amended by  
  110. #adding at the end thereof the following new paragraphs:
  111. #           "(25) The term 'school zone' means-
  112. #                 "(A) in, or on the grounds of, a public, parochial or  
  113. #private school; or
  114. #                 "(B) within a distance of 1,000 feet from the grounds of  
  115. #a public, parochial or private school.
  116. #            "(26) the term 'school' means a school which provides  
  117. #elementary or secondary education, as determined under State law.
  118. #             "(27) The term 'motor vehicle' has the meaning given such  
  119. #term in section 10102 of title 49, United States Code.".
  120. #           (3) PENALTY.-Section 924(a) of such title is amended by adding  
  121. #at the end thereof the following new paragraph:
  122. #               "(4) Whoever violates section 922(q) shall be fined not  
  123. #more than $5,000, imprisoned for not more than 5 years, or both.   
  124. #Notwithstanding any other provision of law, the term of imprisonment  
  125. #imposed under this paragraph shall not run concurrently with any other  
  126. #term of imprisonment imposed under any other provision of law.  Except for  
  127. #the authorization of a term of imprisonment of not more than 5 years made  
  128. #in this paragraph, for the purpose of any other law a violation of section  
  129. #922(q) shall be deemed to be a misdemeanor.".
  130. #             (4) EFFECTIVE DATE.- The amendments made by this section  
  131. #shall apply to conduct engaged in after the end of the 60-day period  
  132. #beginning on the date of the enactment of this Act.
  133. #             (5) GUN-FREE ZONE SIGNS.- Federal, State, and local  
  134. #authorities are encouraged to cause signs to be posted around school zones  
  135. #giving warning of prohibition of firearms in a school zone.
