- I believe that White-Westinghouse lost a lawsuit many years ago for using
- one branch of their business (large appliances?) to subsidize another
- branch of their business (small appliances?). The FTC was convinced that
- it was an unfair business practice designed to drive competitors out of
- the market, and invoked anti-trust laws. I think that that case set quite
- a legal precedence.
-
- IBM has to be sensitive to similar complaints from MS; personally I think
- MS is more wrong than IBM could possibly ever be in terms of fairness of
- microcomputer marketing strategies, but that's just my personal opinion.
- I'm sure that IBM has conservative lawyers.
-
- Of course, if IBM could document that when they released 2.0 that they
- promised 3.1 and complete 32-bit operation [remember, they had 3.1 source
- even if 3.1 wasn't out yet], then they should be able to make a pretty good
- case that they originally sold 3.1 support.
-
- IBM would have a much better case than, for example MS has when they call their
- NT version 3.1 so that they can use their existing licensing agreement with
- Novell -- little as I like Novell's marketing practices, I think that MS
- is scr*ing Novell bad.
-
- But I guess MS's precedent with Novell would be an argument for calling the
- new OS/2 version 2.0.2 or something -- a minor fix only to known deficiencies.
-
- But I would pay for an upgrade -- how many upgrades would depend on how much
- it costs [my 9 year old daughter would have to go back to windows if the
- upgrade cost more than $25 or so].
