- Unless there are extraneous circumstances - The car in front
- was actually in reverse, The car in front suddenly had a
- major catastrophic break down that cause it to dead stop (as
- a "unatural fashion), IT WILL BE NEAR IMPOSSIBLE to - prove
- the car in front was at all at fault. In 99% of the cases, as
- Tom brought up, it comes down to that the car in back could not
- stop in time due to a combination of the following.
-
- Following to close
- Tailgating - the extreme of the first
- Mechanical inadequency - bad brakes or tires
- And the old - Just not paying atention
-
- If the driver of the car in back could disprove the above
- and have a plethora of witnesses proving the driver in front
- did something totally and I mean totally stupid, I'm sorry
- to say the driver in back doesn't stand a chance.
-
-
- By the way did I say this only my opinion and not
- my employers. And my opinions are just that, they
- are not by any means making any legal precedent and
- may not even be based on fact.
