  31. The states can't enforce a law which is unconstitutional under
  32. Roe v. Wade, because it would be challenged if the state attempted
  33. to prosecute a doctor for performing a post-viability abortion:

  35.     "According  to  a  1979  survey  by  Jeanie  Rosoff  of  Planned
  36.    Parenthood's Alan Guttmacher Institute, 30 states have laws regu-
  37.    lating third-trimester abortions. Some of these laws prohibit  or
  38.    strictly  limit  abortions after the fetus has reached viability.
  39.    Some require doctors to try to save  abortion  live-born  babies.
  40.    Only a few states have both types of laws.

  42.      In addition, a number of these laws have been found unconstitu-
  43.    tional.   Others  obviously  would  be, in light of Supreme Court
  44.    rulings. Virtually all the state laws would be subject to consti-
  45.    tutional challenge if used as the basis of prosecution against an
