- When the Pure Food and Drug Act was passed in 1938, it was written so
- that medicines that were currently in use were exempted from the
- testing requirement. This applied equally to both homeopathic and
- allopathic medicines. Since very few new homeopathic medicines have
- been introduced since 1938, the majority of homeopathic medicines have
- not been tested. No special favoritism was shown to homeopathy, and
- the FDA is the last organization (besides the AMA) that I would expect
- to show favoritism to homeopathy! Drug companies spend large sums to
- test new medicines because they are protected by patent, giving them
- exclusive right to manufacture these medicines. Homeopathic medicines
- currently in use cannot be patented. Without patent protection, there
- is no incentive for any profit making company to test them.
