  1. DIMIN Viewer n5 - LICENSE

  3. NON-COMMERCIAL USE ONLY

  5. This software is distributed  free of charge for  non-commercial  purposes only. 
  6. Non-commercial use includes,  but not limited to,  home use,  use by students of 
  7. any kind, use with research purposes and in  research environments.  If you want
  8. to make commercial use of DIMIN Viewer n5, including but not limited to
  9. selling or  distributing DIMIN  Viewer n5  for payment,  you must  enter into an
  10. agreement with author or obtain author's written permission in advance. 
  11.  
  12. DISCLAIMER OF WARRANTY.
  13.  
  14. Free of charge  Software is provided  on an "AS  IS" basis, without  warranty of
  15. any   kind,  including  without limitation  the  warranties  of merchantability,
  16. fitness  for  a particular purpose  and non-infringement. The entire risk  as to
  17. the quality and performance of the Software is borne by you.
  18.  
  19. SCOPE OF GRANT.

  21. You may:
  22. * use the Software on one or more computers;
  23. * use the Software  on a   network,   provided that  each person  accessing  the 
  24.   Software through the network must have a copy licensed to that person;
  25. * copy the Software for archival purposes, provided any copy must contain all of
  26.   the original Software's proprietary notices.

  29. * permit other individuals  to  use  the  Software except under the terms listed

  31. * modify,  translate,  reverse  engineer, decompile, disassemble (except to  the

  36. * remove any proprietary notices or labels on the Software.

  41. in its  sole discretion,  without notice  or liability  to you.  You agree to be

  62. YOU  DOWNLOAD AND/OR  USE DIMIN  VIEWER N5  AND ALL  THIRD PARTY  SOFTWARE MADE
  63. AVAILABLE IN CONJUNCTION WITH OR THROUGH DIMIN VIEWER N5 AT YOUR OWN  DISCRETION
  64. AND  RISK AND  THAT YOU  WILL BE  SOLELY RESPONSIBLE  FOR ANY  DAMAGES TO  YOUR
  65. COMPUTER SYSTEM OR LOSS OF DATA THAT  RESULTS FROM THE DOWNLOAD OR USE OF  DIMIN
  66. VIEWER N5 AND SUCH THIRD PARTY  SOFTWARE. SOME STATES OR OTHER JURISDICTIONS  DO
  67. NOT ALLOW THE EXCLUSION OF IMPLIED  WARRANTIES, SO THE ABOVE EXCLUSIONS MAY  NOT
  68. APPLY TO YOU.  YOU MAY ALSO HAVE  OTHER RIGHTS THAT VARY FROM STATE TO STATE AND

  71. LIMITATION OF LIABILITY

  75. ON ACCOUNT OF THAT USER'S USE OR  MISUSE OF DIMIN VIEWER N5 OR SUCH  THIRD PARTY
  76. SOFTWARE.  SUCH  LIMITATION OF  LIABILITY  SHALL APPLY  TO  PREVENT RECOVERY  OF
  77. DIRECT, INDIRECT,  INCIDENTAL, CONSEQUENTIAL,  SPECIAL, EXEMPLARY,  AND PUNITIVE
  78. DAMAGES  WHETHER SUCH  CLAIM IS  BASED ON  WARRANTY, CONTRACT,  TORT (INCLUDING
  79. NEGLIGENCE),  OR  OTHERWISE,  (EVEN  IF AUTHOR  AND/OR  A  THIRD  PARTY SOFTWARE
  80. PROVIDER HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH  LIMITATION
  81. OF LIABILITY SHALL  APPLY WHETHER THE  DAMAGES ARISE FROM  USE OR MISUSE  OF AND
  82. RELIANCE ON  DIMIN VIEWER  N5 AND  ALL THIRD  PARTY SOFTWARE  MADE AVAILABLE  IN
  83. CONJUNCTION WITH OR THROUGH DIMIN VIEWER N5, FROM INABILITY TO USE DIMIN  VIEWER
  84. N5 AND ALL THIRD  PARTY SOFTWARE MADE AVAILABLE  IN CONJUNCTION WITH OR  THROUGH
  85. DIMIN VIEWER N5, OR FROM  THE INTERRUPTION, SUSPENSION, OR TERMINATION  OF DIMIN
  86. VIEWER N5 AND  ALL THIRD PARTY  SOFTWARE MADE AVAILABLE  IN CONJUNCTION WITH  OR
  87. THROUGH DIMIN VIEWER N5 (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES). SUCH
  88. LIMITATION SHALL  APPLY NOTWITHSTANDING  A FAILURE  OF ESSENTIAL  PURPOSE OF ANY
  89. LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW. SOME STATES OR  OTHER
  90. JURISDICTIONS  DO  NOT  ALLOW  THE  EXCLUSION  OR  LIMITATION  OF  LIABILITY FOR
  91. INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY 
  92. NOT APPLY TO YOU.

  94. USING THE SOFTWARE YOU ARE CONSENTING TO BE BOUND BY THIS AGREEMENT.
