NON-COMMERCIAL USE ONLY

This software is distributed  free of charge for  non-commercial  purposes only. 
Non-commercial use includes,  but not limited to,  home use,  use by students of 
any kind, use with research purposes and in  research environments.  If you want
to make commercial use of DIMIN Viewer n5, including but not limited to
selling or  distributing DIMIN  Viewer n5  for payment,  you must  enter into an
agreement with author or obtain author's written permission in advance. 

DISCLAIMER OF WARRANTY.

Free of charge  Software is provided  on an "AS  IS" basis, without  warranty of
any   kind,  including  without limitation  the  warranties  of merchantability,
fitness  for  a particular purpose  and non-infringement. The entire risk  as to
the quality and performance of the Software is borne by you.

SCOPE OF GRANT.

You may:
* use the Software on one or more computers;
* use the Software  on a   network,   provided that  each person  accessing  the 
  Software through the network must have a copy licensed to that person;
* copy the Software for archival purposes, provided any copy must contain all of
  the original Software's proprietary notices.

You may not:
* permit other individuals  to  use  the  Software except under the terms listed
  above;
* modify,  translate,  reverse  engineer, decompile, disassemble (except to  the
  extent  applicable  laws  specifically prohibit such restriction ), or  create 
  derivative works based on the Software;
* rent, lease, grant a security interest in, or otherwise transfer rights to the 
  Software; or
* remove any proprietary notices or labels on the Software.

Author reserves the right to modify these Terms and Conditions from time to time
in its  sole discretion,  without notice  or liability  to you.  You agree to be
bound by these Terms and Conditions, as modified. Please review the most current
version of    the Terms and   Conditions from time to   time so that you will be 
apprised of any changes.

Author and any third party who makes its software available in conjunction  with
or through DIMIN  Viewer n5 disclaim  any responsibility for  any harm resulting
from your use of DIMIN Viewer n5 and/or any third party software 
accessed in conjunction with or through DIMIN Viewer n5.
 
DIMIN VIEWER N5 AND ANY THIRD PARTY SOFTWARE MADE AVAILABLE IN CONJUNCTION  WITH
OR THROUGH DIMIN VIEWER N5 ARE PROVIDED "AS IS," WITH NO WARRANTIES  WHATSOEVER.
AUTHOR AND SUCH THIRD PARTIES EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED

ITS SOFTWARE AVAILABLE IN CONJUNCTION  WITH OR THROUGH DIMIN VIEWER  N5 DISCLAIM
ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND  PERFORMANCE
OF DIMIN VIEWER N5 AND SUCH THIRD PARTY SOFTWARE. YOU UNDERSTAND AND AGREE  THAT
YOU  DOWNLOAD AND/OR  USE DIMIN  VIEWER N5  AND ALL  THIRD PARTY  SOFTWARE MADE
AVAILABLE IN CONJUNCTION WITH OR THROUGH DIMIN VIEWER N5 AT YOUR OWN  DISCRETION
AND  RISK AND  THAT YOU  WILL BE  SOLELY RESPONSIBLE  FOR ANY  DAMAGES TO  YOUR
COMPUTER SYSTEM OR LOSS OF DATA THAT  RESULTS FROM THE DOWNLOAD OR USE OF  DIMIN
VIEWER N5 AND SUCH THIRD PARTY  SOFTWARE. SOME STATES OR OTHER JURISDICTIONS  DO
NOT ALLOW THE EXCLUSION OF IMPLIED  WARRANTIES, SO THE ABOVE EXCLUSIONS MAY  NOT
APPLY TO YOU.  YOU MAY ALSO HAVE  OTHER RIGHTS THAT VARY FROM STATE TO STATE AND 
JURISDICTION TO JURISDICTION. 

LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL  AUTHOR OR ANY THIRD  PARTY WHO MAKES ITS  SOFTWARE
AVAILABLE IN CONJUNCTION WITH OR THROUGH  DIMIN VIEWER N5 BE LIABLE TO  ANY USER
ON ACCOUNT OF THAT USER'S USE OR  MISUSE OF DIMIN VIEWER N5 OR SUCH  THIRD PARTY
SOFTWARE.  SUCH  LIMITATION OF  LIABILITY  SHALL APPLY  TO  PREVENT RECOVERY  OF
DIRECT, INDIRECT,  INCIDENTAL, CONSEQUENTIAL,  SPECIAL, EXEMPLARY,  AND PUNITIVE
DAMAGES  WHETHER SUCH  CLAIM IS  BASED ON  WARRANTY, CONTRACT,  TORT (INCLUDING
NEGLIGENCE),  OR  OTHERWISE,  (EVEN  IF AUTHOR  AND/OR  A  THIRD  PARTY SOFTWARE
PROVIDER HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH  LIMITATION
OF LIABILITY SHALL  APPLY WHETHER THE  DAMAGES ARISE FROM  USE OR MISUSE  OF AND
RELIANCE ON  DIMIN VIEWER  N5 AND  ALL THIRD  PARTY SOFTWARE  MADE AVAILABLE  IN
CONJUNCTION WITH OR THROUGH DIMIN VIEWER N5, FROM INABILITY TO USE DIMIN  VIEWER
N5 AND ALL THIRD  PARTY SOFTWARE MADE AVAILABLE  IN CONJUNCTION WITH OR  THROUGH
DIMIN VIEWER N5, OR FROM  THE INTERRUPTION, SUSPENSION, OR TERMINATION  OF DIMIN
VIEWER N5 AND  ALL THIRD PARTY  SOFTWARE MADE AVAILABLE  IN CONJUNCTION WITH  OR
THROUGH DIMIN VIEWER N5 (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES). SUCH
LIMITATION SHALL  APPLY NOTWITHSTANDING  A FAILURE  OF ESSENTIAL  PURPOSE OF ANY
LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW. SOME STATES OR  OTHER
JURISDICTIONS  DO  NOT  ALLOW  THE  EXCLUSION  OR  LIMITATION  OF  LIABILITY FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY 
NOT APPLY TO YOU. 

USING THE SOFTWARE YOU ARE CONSENTING TO BE BOUND BY THIS AGREEMENT.
