  5.                               LICENSE AGREEMENT

  8. For the purposes of this document, Software refers to a playable demo or
  9. shareware version of the program being distributed with this document.
  10.  
  11. The following Agreement is a legal agreement between you, the "End User" of
  12. this Software, and the publisher of the Software, Impulse Games, Inc.
  13.  
  14. 1. End Users of this Software are licensed to use this Software on a trial
  15.    basis for a period of no more than thirty (30) days from initial receipt.
  16.    After this period, the End User must either purchase the complete
  17.    product, or discontinue use of the Software.
  18.  
  19. 2. The Software may be distributed freely on Bulletin Board Services, On-Line
  20.    Services, and any other method that does not charge more than a nominal
  21.    fee ($1) to cover handling costs for access to the Software.
  22.    Those wishing to charge a fee for this Software shall be governed under
  23.    the terms set forth in the included document, "VENDINFO.DIZ".

  25. 3. COPYRIGHT NOTICE:

  27.    This Software is protected by United States copyright laws and
  28.    international treaty provisions.  Copying any part or the "look and feel"
  29.    of this Software is strictly forbidden.

  31. 4. LIMITED WARRANTY AND DISCLAIMER:

  33.    THIS SOFTWARE IS PROVIDED "AS-IS".  IMPULSE GAMES DOES NOT WARRANT
  34.    THAT THE OPERATION OF THIS SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
  35.    IMPULSE GAMES WARRANTS THE MEDIUM THIS SOFTWARE WAS SHIPPED ON TO BE
  36.    FREE FROM DEFECTS FOR NINETY (90) FROM DATE OF RECEIPT AND WILL REPLACE
  37.    ANY DEFECTIVE DISK OR CD-ROM WITHIN THAT TIME PERIOD.

  39.    UNDER NO CIRCUMSTANCES WILL IMPULSE GAMES BE LIABLE FOR ANY DAMAGES,
  40.    INCLUDING LOSS OF DATA, LOST REVENUE, COST OF COVER, OR OTHER SPECIAL,
  41.    INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING FROM THE USE OR
  42.    ATTEMPTED USE OF THIS SOFTWARE OR ACCOMPANYING DOCUMENTATION, HOWEVER
  43.    CAUSED AND ON ANY THEORY OF LIABILITY.  THIS LIMITATION WILL APPLY EVEN
  44.    IF IMPULSE GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
  45.    THE SOLE REMEDY FOR LOSS OR DAMAGE FROM USE OF THIS SOFTWARE, INDIRECTLY
  46.    OR OTHERWISE, SHALL BE LIMITED TO REFUND OF THE PURCHASE PRICE.
  47.    NO OTHER WARRANTIES ARE MADE RELATING TO THIS SOFTWARE, WHETHER EXPRESS,
  48.    IMPLIED, OR STATUTORY.

  50.    SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE
  51.    EXCLUSIONS MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL 
  52.    RIGHTS.  YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
  53.    THIS AGREEMENT SHALL BE GOVERNED BY THE LAWS OF THE STATE OF INDIANA.
