  3. PLEASE READ THIS SOFTWARE LICENSE AGREEMENT "LICENSE" 
  4. CAREFULLY BEFORE INSTALLING THE SOFTWARE. BY INSTALLING THE 
  5. SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS 
  6. LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, 
  7. YOU ARE NOT AUTHORIZED TO INSTALL THIS SOFTWARE.

  9. 1. License. The software and any fonts accompanying this 
  10. License whether on disk, in read only memory, or on any 
  11. other media (the Geomantics Software) are licensed, not 
  12. sold, to you by Geomantics Ltd. or its local subsidiary, 
  13. if any. YOU OWN THE MEDIA ON WHICH THE GEOMANTICS 
  14. SOFTWARE IS RECORDED BUT GEOMANTICS AND/OR GEOMANTICS'S 
  15. LICENSOR(S) RETAIN TITLE TO THE GEOMANTICS SOFTWARE. The
  16. Geomantics Software in this package and any copies which 
  17. this License authorizes you to make are subject to this 
  18. License.

  20. 2. Permitted Uses and Restrictions. This License allows 
  21. you to install and use the Geomantics Software on a single 
  22. computer at a time. This License does not allow the 
  23. Geomantics Software to exist on more than one computer at 
  24. a time. You may make one copy of the Geomantics Software 
  25. in machine-readable form for backup purposes only. The 
  26. backup copy must include all copyright information contained 
  27. on the original. Except as permitted by applicable law and 
  28. this License, you may not decompile, reverse engineer, 
  29. disassemble, modify, rent, lease, loan, distribute, create 
  30. derivative works from the Geomantics Software or transmit 
  31. the Geomantics Software over a network. You may not, 
  32. transfer your rights under this License without the prior 
  33. written consent of Geomantics Ltd. Your rights under this 
  34. License will terminate automatically without notice from 
  35. Geomantics if you fail to comply with any term(s) of this

  38. 3. Disclaimer of Warranty on Geomantics Software. You 
  39. expressly acknowledge and agree that use of the Geomantics 
  40. Software is at your sole risk. The Geomantics Software is 
  41. provided AS IS and without warranty of any kind and 
  42. Geomantics and Geomantics's licensor(s) (for the purposes 
  43. of provisions 3 and 4, Geomantics and Geomantics's 
  44. licensor(s) shall be collectively referred to as 
  45. "Geomantics")

  47. EXPRESSLY DISCLAIM ALL WARRANTIES AND/OR CONDITIONS, 
  48. EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE 
  49. IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY OR 
  50. SATISFACTORY QUALITY AND FITNESS FOR A PARTICULAR PURPOSE. 
  51. GEOMANTICS DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED 
  52. IN THE GEOMANTICS SOFTWARE WILL MEET YOUR REQUIREMENTS, 
  53. OR THAT THE OPERATION OF THE GEOMANTICS SOFTWARE WILL BE 
  54. UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE 
  55. GEOMANTICS SOFTWARE WILL BE CORRECTED. FURTHERMORE, 
  56. GEOMANTICS DOES NOT WARRANT OR MAKE ANY  REPRESENTATIONS 
  57. REGARDING THE USE OR THE RESULTS OF THE USE OF THE 
  58. GEOMANTICS SOFTWARE OR RELATED DOCUMENTATION IN TERMS OF 
  59. THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. 
  60. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY 
  61. GEOMANTICS OR AN GEOMANTICS AUTHORIZED REPRESENTATIVE 
  62. SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE 
  63. OF THIS WARRANTY. SHOULD THE GEOMANTICS SOFTWARE PROVE 
  64. DEFECTIVE, YOU (AND NOT GEOMANTICS OR AN GEOMANTICS 
  65. AUTHORIZED REPRESENTATIVE) ASSUME THE ENTIRE COST OF ALL 
  66. NECESSARY SERVICING, REPAIR OR CORRECTION.

  68. 4. Limitation of Liability. UNDER NO CIRCUMSTANCES, 
  69. INCLUDING NEGLIGENCE, SHALL GEOMANTICS BE LIABLE FOR ANY 
  70. INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES 
  71. ARISING OUT OF OR RELATING TO THIS LICENSE. In no event 
  72. shall Geomantics's total liability to you for all 
  73. damages exceed the amount paid for this License to the 
  74. Geomantics Software.

  76. 5. This License shall be governed by the laws of Scotland, 
  77. UK. If for any reason a court of competent jurisdiction 
  78. finds any provision, or portion thereof, to be 
  79. unenforceable, the remainder of this License shall 
  80. continue in full force and effect.

  82. 6. Complete Agreement. This License constitutes the 
  83. entire agreement between the parties with respect to 
  84. the use of the Geomantics Software and supersedes all 
  85. prior or contemporaneous understandings regarding such 
  86. subject matter. No amendment to or modification of this 
  87. License will be binding unless in writing and signed by 
  88. Geomantics.
