  33. Reverse engineering. You agree that you will not attempt to reverse compile, modify, 
  34. translate, or disassemble the software in whole or in part.

  37. respect to the software, either express or implied, including, but not limited to, implied 
  38. warranties of merchantability, fitness for a particular purpose and non-infringement of 
  39. third party rights.

  41. There is no liability for consequential damages. In no event shall I or my suppliers be 
  42. liable to you for any consequential, special, incidental or indirect damages of any kind 
  43. arising out of the delivery, performance or use of the software, even if I have been 
  44. advised of the possibility of such damages. In no event will my liability for any claim, 
  45. whether in contract, tort or any other theory of liability, exceed the license fee paid 
  46. by you, if any.
