  2.             TEXTURE GARDEN LICENSE

  5.    Terms and conditions for copying, distribution and modification.

  7. This document represents a legal agreement between you (either an individual
  8. or a legal entity) and Mr Timothy M Tyler ("Tim Tyler") who hereby asserts
  9. his right to be identified as author ("the author") of the program which
  10. accompanies this license.  Completing reading this agreement constitutes
  11. acknowledgement all of its conditions.  Tim Tyler reserves all rights not
  12. expressly granted.

  14.   0. This license agreement applies to the "Texture Garden" program.  The
  15. "program", below, refers to the above work, and a "work based on the program"
  16. means either the program or any work containing the program or a portion of
  17. it, either verbatim or with modifications.  A list of the files covered by
  18. this licence is contained in the "Files" file.  This licence explicitly does
  19. not refer to the "TextureReg" module which may only be distributed by the
  20. author of the program.  Each licensee is addressed as "you".

  22.   1. You may copy and distribute verbatim copies of the program's code as you
  23. receive it, provided that you include all the files you received with it in
  24. an unmodified form, including this file.  You may not impose any further
  25. restrictions on the recipients' exercise of the rights granted herein.  The
  26. program may be distributed through any medium and you may charge a fee of any
  27. magnitude for the physical act of transferring a copy, and for any other
  28. services you may wish to offer to recipients.  Recipients of the program are
  29. advised that the software is intended by the author to be essentially free.

  31.   2. You may modify your copy or copies of the program or any portion of it,
  32. provided you do not attempt to redistribute the modified version.  If you
  33. believe the modifications are of a constructive nature you are invited to
  34. discuss the matter with the author.

  55. and/or redistribute the program as permitted above, be liable to you for any
  56. damages whatsoever, including without limitation, damages for loss of
  57. business profit, business interruption, loss of business information, or any
  58. other pecuniary loss, any general, special, incidental or consequential
  59. damages arising out of the use or inability to use the program (including but
  60. not limited to loss of data or data being rendered inaccurate or losses
  61. sustained by you or third parties or a failure of the program to operate with
  62. any other programs), even if such holder or other party has been advised of
  63. the possibility of such damages: the program is provided "as is" without
  64. warranty of any kind, either expressed or implied, including, but not limited
  65. to, the implied warranties of merchantability and fitness for a particular
  66. purpose.  The entire risk as to the quality and performance of the program
  67. lies with you.  Should the program prove defective, you assume the cost of
  68. all necessary servicing, repair or correction.  The author's entire liability
  69. and your exclusive remedy shall not exceed the price paid for the software. 
  70. Because some jurisdictions do not allow the exclusion or limitation of
  71. liability for consequential or incidental damages, the above limitation may
  72. not apply to you.
