  4. SECTION 43-43B-1 Unlawful uses of a computer-- A person is guilty 
  5. of unlawful use of a computer when he:
  6.  
  7.      (1) Knowingly obtains the use of a computer system, or any 
  8.      part thereof, without the consent of the owner;
  9.  
  10.      (2) Knowingly alters or destroys computer programs or data 
  11.      without the consent of the owner; or
  12.  
  13.      (3) Knowingly obtains use of, alters or destroys a computer 
  14.      system, or any part thereof, as part of a deception for the 
  15.      purpose of obtaining money, property or services from the 
  16.      owner of a computer system or any third party.
  17.  
  18. SECTION 43-43B-2 Definition of terms. Terms used in this chapter, 
  19. unless the context requires otherwise, mean:
  20.  
  21.      (1) "Computer", an internally programmed, general purpose 
  22.      digital device capable of automatically accepting data, 
  23.      processing data and supplying the results of the operation;
  24.  
  25.      (2) "Computer system" a set of related, connected devices 
  26.      including a computer and other devices, including but not 
  27.      limited to data input and output and storage devices, data 
  28.      communications links, and computer programs and data, that 
  29.      make the system capable of performing the special purpose 
  30.      data processing tasks for which it is specified;
  31.  
  32.      (3) "Computer program," a series of coded instructions, or 
  33.      statements in a form acceptable to a computer, which causes 
  34.      the computer to process data in order to achieve a certain 
  35.      result.

  37. SECTION 43-43B-3. Obtaining use, altering or destroying system 
  38. without consent - Value - one thousand dollars or less. A person 
  39. convicted of a violation of subdivision (1) or (2) of section 43-
  40. 43B-1 where the value of the use, alteration or destruction is 
  41. one thousand dollars or less is guilty of a Class 2 misdemeanor.

  43. SECTION 43-43B-4. Obtaining use, altering or destroying system 
  44. without consent - Value more than one thousand dollars. A person 
  45. convicted of a violation of subdivision (1) or (2) of section 43-
  46. 43B-1 where the value of the use, alteration or destruction is 
  47. more than one thousand dollars is guilty of a Class 1 
  48. misdemeanor.

  50. SECTION 43-43B-5. Obtaining use, altering or destroying system as 
  51. part of deception- Value one thousand dollars or less. A person 
  52. convicted of a violation of subdivision (3) of section 43-43B-1 
  53. where the value of the money, property or services obtained, is 
  54. one thousand dollars or less is guilty of a Class 1 misdemeanor.

  56. SECTION 43-43B-6. Obtaining use, altering or destroying system as 
  57. part of deception- Value more than one thousand dollars. A person 
  58. convicted of a violation of subdivision (3) of section 43-43B-1 
  59. where the value of the money, property or services obtained, is 
  60. more than one thousand dollars is guilty of a Class 1 
  61. misdemeanor.

  63. SECTION 43-43B-7. Civil rights not affected. The provisions of 
  64. this chapter shall neither enlarge or diminish the rights of 
  65. parties in civil litigation.
