  4. SECTION 28-1343. Terms, defined.
  5.  
  6.     For the purposes of sections 28-1343 to 28-1348, unless the 
  7. context otherwise requires:
  8.  
  9.     (1) Access shall mean to instruct, to communicate with, store 
  10. data in, retrieve data from or otherwise use the resources of a 
  11. computer computer network;
  12.  
  13.     (2) Computer shall mean a high-speed data processing device 
  14. or system which performs logical, arithmetic, data storage and 
  15. retrieval, communication or control functions, and includes any 
  16. input, output, data storage, processing, or communications 
  17. facilitates directly related to or operating in conjunction with 
  18. any such device or system;
  19.  
  20.     (3) Computer network shall  mean the interconnection of 
  21. communication links with a computer or an interconnection of 
  22. computers which communicate with each other;
  23.  
  24.     (4) Computer program shall mean an ordered set of 
  25. instructions, statements or related data that directs or is 
  26. intended to direct the computer to perform certain specified 
  27. functions;
  28.  
  29.     (5) Data shall mean a representation or information, facts, 
  30. knowledge, concepts or instructions prepared in a formalized or 
  31. other manner and intended for use in a computer or computer 
  32. network;
  33.  
  34.     (6) Property shall mean any tangible or intangible thing of 
  35. value and shall include, but not be limited to, financial 
  36. instruments, data, computer programs, information, computer-
  37. produced or stored data whether in human readable or computer 
  38. readable form.

  41. SECTION 97-45-3. Computer fraud; penalties.
  42.     
  43.     (1) Computer fraud is the accessing or causing to be accessed 
  44. of any computer, computer system, computer network, or any part 
  45. thereof with the intent to:
  46.  
  47.     (a) Defraud, or
  48.  
  49.     (b) To obtain money, property or services by means of false 
  50. or fraudulent conduct, practices or representations; or through 
  51. the false or fraudulent alteration, deletion or insertion of 
  52. programs or data.
  53.  
  54. (2) Whoever commits the offense of computer fraud shall be 
  55. punished, upon conviction, by a fine of not more than Ten 
  56. Thousand Dollars, or by imprisonment for not more than five 
  57. years, or both by such fine and imprisonment.
  58.  
  59. SECTION 97-45-5. Offense against computer users; penalties
  60.  
  61.     (1) An offense against computer users is the intentional:
  62.  
  63.          (a) denial to an authorized user, without consent, of          
  64.          the full and effective use of or access to a computer, a 
  65.          computer system, a computer network or computer 
  66.          services; or
  67.  
  68.          (b) use or disclosure to another, without consent, of 
  69.          the numbers, codes, passwords or other means of access 
  70.          to a computer, a computer system, a computer network, or 
  71.          computer services. 
  72.  
  73.     (2) Whoever commits an offense against computer users shall 
  74. be punished, upon conviction, by a fine of not more than One 
  75. Thousand Dollars ($ 1,000), or by imprisonment for not more than 
  76. six months, or by both such fine and imprisonment. However, when 
  77. the damage or loss amounts to a value of One Hundred Dollars or 
  78. more, the offender may be punished, upon convictions, by a fine 
  79. of not more than Ten Thousand Dollars, or imprisonment for not 
  80. more than 5 years, or by both such fine and imprisonment.

  82. SECTION 97-45-7. Offense against computer equipment, penalties.
  83.  
  84.     (1) An offense against intellectual property is the 
  85. intentional:
  86.  
  87.          (a) Destruction, insertion or modification, without 
  88.          consent, of intellectual property; or
  89.  
  90.          (b) Disclosure, use, copying, taking or accessing, 
  91.          without consent, of intellectual property.
  92.  
  93.     (2) Whoever commits an offense against intellectual property 
  94. shall be punished, upon conviction, by a fine of not more than 
  95. One Thousand Dollars ($ 1,000), or by imprisonment for not more 
  96. than six months, or by both such fine and imprisonment. However, 
  97. when the damage or loss amounts to a value of One Hundred Dollars 
  98. or more, the offender may be punished, upon convictions, by a 
  99. fine of not more than Ten Thousand Dollars, or imprisonment for 
  100. not more than 5 years, or by both such fine and imprisonment.

  102.     (3) The provisions of this section shall not apply to the 
  103. disclosure, use, copying, taking, or accessing by proper means as 
  104. defined in this chapter.
