  4. SECTION 45-2-101 General definitions. Unless otherwise specified 
  5. in the statute,, all words will be taken in the objective 
  6. standard rather than in the subjective, and unless a different 
  7. meaning plainly is required, the following definitions apply in 
  8. this title:

  14.      (1) "Acts" has its usual and ordinary meaning and includes 
  15. any bodily movement, any form of communication, and where 
  16. relevant, a failure or omission to take action.

  20.      (3) "Another" means a person or persons, as defined in this 
  21. code, other than the offender.
  22.  
  23.      (4) "Benefit" means gain or advantage or anything regard by 
  24. the beneficiary as gain or advantage, including benefit to any 
  25. other person or entity un whose welfare he is interested, but not 
  26. an advantage promised generally or a group or class of voters a  
  27. a consequence of public measures which a candidate engages to 
  28. support or oppose.

  30. SECTION 45-6-310 Definition-- computer use. As used in 45-6-311, 
  31. the term "obtain the use of" means to instruct, communicate with, 
  32. store data in, retrieve data from, cause input to, cause output 
  33. from, or otherwise make use of any resources of a computer, 
  34. computer system, or computer network or to cause another to 
  35. instruct, communicate with, store data in, retrieve data from, 
  36. cause input to, cause output from, or otherwise make use of any 
  37. resources of a computer, computer system, or computer network.

  39. SECTION 45-6-311 UNLAWFUL USE OF A COMPUTER  (1) A person commits 
  40. the offense of unlawful use of a computer if he knowingly or 
  41. purposefully:
  42.  
  43.      (a) obtains the use of any computer, computer system, or 
  44. computer network without the consent of the owner;
  45.  
  46.      (b) alters or destroys or causes another to alter or destroy 
  47. a computer program or computer software without consent of the 
  48. owner; or
  49.  
  50.      (c) obtains the use of or alters or destroys a computer, 
  51. computer system, computer network, or any part thereof as part of 
  52. a deception for the purpose of obtaining money, property, or 
  53. computer services from the owner of the computer, computer 
  54. system, computer network, or part thereof or from any other 
  55. person.

  57.      (2) A person convicted of the offense of unlawful use of a 
  58. computer involving property not exceeding $300.00 in value, 
  59. shall be fined not to exceed $500.00 or be imprisoned in the 
  60. county jail not to exceed six months, or both.  A person 
  61. convicted of the offense of unlawful use of a computer involving 
  62. property exceeding $300.00 in value shall be fined not more than 
  63. 2 1/2 times the value of the property used, altered, destroyed, 
  64. or obtained, or be imprisoned in the state prison for a term not 
  65. to exceed 10 years, or both.
