  4. SECTION 752.791 Meanings of words and phrases
  5.  
  6.     Sec. 1. For the purpose of this act, the words and phrases 
  7. defined in section 2 and 3 have the meanings ascribed to them in 
  8. those sections.
  9.  
  10. SECTION 752.792 Definitions
  11.  
  12.     Sec. 2 (1) "Access" means to approach, instruct, communicate 
  13. with, store data in, retrieve data from, or otherwise use the 
  14. resources of, a computer, computer system,or computer network.
  15.  
  16.     (2) "Computer" means an electronic device which performs 
  17. logical, arithmetic, and memory functions by the manipulations of 
  18. electronic or magnetic impulses, and includes input, output, 
  19. processing, storage, software, or communications facilities which 
  20. are connected or related to a device in a system or network.
  21.  
  22.      (3) "Computer network" means the interconnection of 
  23. communications lines with a computer through remote terminals, or 
  24. a complex consisting of 2 or more interconnected computers.
  25.  
  26.      (4) "Computer program" means a series of instructions or 
  27. statements, in a form acceptable to a computer, which permits the 
  28. functioning of a computer system in a manner designed to provide 
  29. appropriate products from the computer system.
  30.  
  31.      (5) "Computer software" means a set of computer programs, 
  32. procedures, and associated documentation concerned with the 
  33. operation of a computer system.
  34.  
  35.      (6) "Computer system" means a set of related, connected or 
  36. unconnected equipment, devices and software.

  38. SECTION 752.793 Definitions
  39.  
  40.      (1) "Property" includes financial instruments; information, 
  41. including electronically produced data; computer software and 
  42. programs in either machine or human readable form; and any other 
  43. tangible or intangible item of value.
  44.  
  45.      (2) "Services" includes computer time, data processing, and 
  46. storage functions.

  48. SECTION 752.794 Access to computers for devising or executing 
  49. scheme to defraud or obtain money, property, or service
  50.  
  51.      A person shall not, for the purpose of devising or executing 
  52. a scheme or artifice with intent to defraud or for the purpose of 
  53. obtaining money, property, or a service by means of a false or 
  54. fraudulent pretense, representation, or promise with intent to, 
  55. gain access to or cause access to be made to a computer, computer 
  56. system or computer network.

  58. SECTION 752.795 Gaining access to alter, damage, or destroy 
  59. computers computer programs, or data
  60.  
  61.      A person shall not intentionally and without authorization, 
  62. gain access to, alter, damage, or destroy a computer, computer 
  63. system, or computer network, or gain access to, alter, damage, or 
  64. destroy a computer software program or data contained in a 
  65. computer, computer system, or computer network.

  67. SECTION 752.796 Use of computers to commit violations of certain 
  68. sections
  69.  
  70.      A person shall not utilize a computer, computer system, or 
  71. computer network to commit a violation of:

  79. SECTION 752.797 Violations, misdemeanor, felony, penalties
  80.  
  81.      A person who violated this act, if the violation involves $ 
  82. 100.00 or less, is guilty of a misdemeanor. If the violation 
  83. involves more than $ 100.00, the person is guilty of a felony, 
  84. punishable by imprisonment for not more than 10 years, or a fine 
  85. of not more than $ 5,000.00 or both.
