  4. 35-43-1-4. Computer tampering.- (a) As used in this section:
  5.  
  6. "Computer network" and "computer system" have the meaning set 
  7. forth in IC 35-43-2-3.
  8.  
  9. "Computer program" means an ordered set of instructions or 
  10. statements that, when executed by a computer, causes the computer 
  11. to process data.
  12.  
  13. "Data" means a representation of information, facts, knowledge, 
  14. concepts or instructions that:
  15.  
  16.      (1) May take any form, including computer print outs, 
  17. magnetic storage media, punched cards, or stored memory;
  18.  
  19.      (2) Has been prepared or is being prepared; and
  20.  
  21.      (3) Has been processed, is being processed, or will be 
  22. processed, in a computer system or computer network.
  23.  
  24. (b) A person who knowingly or intentionally alters or damages a 
  25. computer program or data, which comprises a part of a computer 
  26. system or computer network without the consent of the owner of the 
  27. computer system or computer network commits computer tampering, a 
  28. Class D felony.
  29.  
  30. 35-43-2-3. Computer trespass- (a) As used in this section:
  31.  
  32.      "Access" means to:
  33.  
  34.      (1) Approach;
  35.  
  36.      (2) Instruct;
  37.  
  38.      (3) Communicate with;
  39.  
  40.      (4) Store data in;
  41.  
  42.      (5) Retrieve data from; or
  43.  
  44.      (6) Make used of resources of;
  45.  
  46. a computer, a computer system, or computer network.
  47.  
  48. "Computer network" means the interconnection of communication 
  49. lines with a computer through remote terminals or a complex 
  50. consisting of two (2) or more interconnected computers.
  51.  
  52. "Computer system" means a set of related computer equipment, 
  53. software or hardware.
  54.  
  55. (b) A person who knowingly or intentionally accesses:
  56.  
  57.      (1) A computer system;
  58.  
  59.      (2) A computer network;
  60.  
  61.      (3) Any part of a computer system or computer network;
  62.  
  63. without the consent of the owner of the computer system or 
  64. computer network, without the consent of the owner's licensee, 
  65. commits computer trespass, a Class A misdemeanor.
