  4. SECTION 18-2201 Definitions.-- As used in this chapter:
  5.

  7.     (1) To "access" means to instruct, communicate with, store 
  8. data in, retrieve data from, or otherwise make use of any of the 
  9. resources of a computer, computer system or computer network.
  10.  
  11.     (2) "Computer" means, but is not limited to, an electronic 
  12. device which performs logical, arithmetic, or memory functions by 
  13. the manipulations of electronic or magnetic impulses, and 
  14. includes all output, processing, storage, software or 
  15. communication facilities which are connected to or related to 
  16. such a device in a system or network.
  17.  
  18.     (3) "Computer network" means, but is not limited to, the 
  19. interconnection of communications lines (including microwave or 
  20. other means of electronic communication) with a computer through 
  21. remote terminals, or a complex consisting of two (2) or more 
  22. interconnected computers.

  24.     (4) "Computer program" means, but is not limited to, a series 
  25. of of instructions or statements, in a form acceptable to a 
  26. computer, which permits the functioning of a computer system in a 
  27. manner designed to provide appropriate products from such computer 
  28. system.

  30.     (5) "Computer software", means but is not limited to, 
  31. computer programs, procedures and associated documentation 
  32. concerned with the operation of a computer system.
  33.  
  34.     (6) "Computer system", a set of related, connected or 
  35. unconnected, computer equipment, devices, and software.
  36.  
  37.     (7) "Property" includes, but is not limited to, financial 
  38. instruments, information, including electronically produced data, 
  39. and computer software and programs in either machine or human 
  40. readable form, and any other tangible or intangible item of 
  41. value.

  43.     (8) "Services" include, but are not limited to, computer 
  44. time, data processing and storage functions.
  45.  
  46. SECTION 18:2202. Computer crime.--
  47.  
  48.     (1) Any person who knowingly accesses, attempts to access or 
  49. uses, or attempts to use any computer, computer system, computer 
  50. network, or nay part thereof for the purpose of: devising or 
  51. executing and scheme or artifice to defraud; obtaining money, 
  52. property, or services by means of false or fraudulent pretenses, 
  53. representations, or promises; or committing theft, commits 
  54. computer crime.
  55.  
  56.     (2) Any person who knowingly and without authorization 
  57. alters, damages, or destroys any computer, computer system, or 
  58. computer network, described in section 18-2201, Idaho Code, or 
  59. any computer software, program, documentation, or data contained 
  60. in which computer, computer system or computer network commits 
  61. computer crime.

  63.     (3) Any person who knowingly and without authorization uses, 
  64. accesses or attempts to access any computer, computer system, or 
  65. computer network described in section 18-2201, Idaho Code, or any 
  66. computer software, program, documentation or data contained in 
  67. such computer, computer system, or computer network, commits 
  68. computer crime.
  69.  
  70.     (4) A violation of the provisions of subsections (1) or (2) 
  71. of this section shall be a felony. A violation of the provisions 
  72. of subsection (3) of this section shall be a misdemeanor.
