  4. NOTICE TO USER:
  5. THIS IS A CONTRACT. BY INDICATING YOUR ACCEPTANCE BELOW,  YOU  ACCEPT
  6. ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.

  9. A. License
  10.  
  11. This  H&H  Software  Vertrieb  GbR   End   User   License   Agreement
  12. accompanies  an  H&H   Software   Vertrieb   GbR   software   product
  13. ("Software")    and    related    explanatory    written    materials
  14. ("Documentation").  The  term  "Software"  shall  also  include   any
  15. upgrades, modified versions, updates, additions, and  copies  of  the
  16. Software licensed to you by H&H Software Vertrieb GbR. This  copy  of
  17. the Software is licensed to you as the end user or your  employer  or
  18. another third party authorized to permit your use  of  the  Software.
  19. "You" as used in the remainder of this License  Agreement  refers  to
  20. the license. H&H Software Vertrieb GbR  may have a written  agreement
  21. with the license that  varies some of the terms  of  this  Agreement,
  22. such as the Permitted Number of Computers. The "Permitted  Number  of
  23. Computers" as used in the remainder of this License Agreement is  one
  24. (1) unless you have a written agreement which specifies otherwise.
  25. The license must  read this  Agreement  carefully  before  indicating
  26. acceptance at the end of the text of this Agreement. If you  are  the
  27. license  and you do not agree with the terms and conditions  of  this
  28. Agreement, decline where instructed, and you will not be able to  use
  29. the Software.

  31. H&H Software Vertrieb GbR grants to you  a  nonexclusive  license  to
  32. use the Software and Documentation, provided that you  agree  to  the
  33. following:

  35. A patch/trainer/etc. of Unprotect may be used only, if one also  owns
  36. the fitting game in original. Lending or further foreign programs  of
  37. course aren't allowed to be processed with our product. This  product
  38. serves under  no  circumstances  as  tool  for  the  establishing  of
  39. illegal copies and may not be used to to break any laws!
  40. The ownership of illegal copies is criminal  and  should  NOT  be  be
  41. supported by this program!!!
  42.  
  43. Use of the Software. You may
  44. ╖ Install the Software in a single location on a hard disk  or  other
  45.   storage device on a single computer.
  46. ╖ Make one backup copy of the Software,  provided  your  backup  copy
  47.   is not installed or used on any computer.
  48.  
  49. HOME USE. The primary user of each computer on which the Software  is
  50. installed or used may also  install  the  Software  on  one  home  or
  51. portable computer. However, the Software  may  not  be  used  on  the
  52. secondary computer by another person at the same  time  the  Software
  53. on the primary computer is being used.

  56. B. Intellectual Property rights
  57.  
  58. The  Software  is  owned  by  H&H  Software  Vertrieb  GbR  and   its
  59. suppliers, and its structure, organization and code are the  valuable
  60. trade secrets of H&H Software Vertrieb GbR  and  its  suppliers.  The
  61. Software  is  also  protected   by   Germanys   Copyright   Law   and
  62. International Treaty provisions. You must treat the Software just  as
  63. you would any other copyrighted material, such as  a  book.  You  may
  64. not copy the Software or the Documentation, except as  set  forth  in
  65. the "Use of the Software" section, the shareware  and  demo  versions
  66. and the manual. Any copies that you are permitted  to  make  pursuant
  67. to  this  Agreement  must  contain  the  same  copyright  and   other
  68. proprietary notices that appear on or in the Software. You agree  not
  69. to   modify,   adapt,   translate,   reverse   engineer,   decompile,
  70. disassemble or otherwise attempt to discover the source code  of  the
  71. Software. Trademarks  shall  be  used  in  accordance  with  accepted
  72. trademark practice, including  identification  of  trademark  owner's
  73. name.  Trademarks  can  only  be  used  to  identify  printed  output
  74. produced by the Software. Such use of any  trademark  does  not  give
  75. you any rights of ownership  in  that  trademark.  Except  as  stated
  76. above, this Agreement does not grant you  any  intellectual  property
  77. rights in the Software.

  80. C. Transfer

  82. You  may  not  rent,  lease,  sublicense  or  lend  the  Software  or
  83. Documentation. You may, however, transfer all your rights to use  the
  84. Software  to  another  person  or  legal  entity  provided  that  you
  85. transfer this Agreement, the Software, including all copies,  updates
  86. and prior versions, and all Documentation to such  person  or  entity
  87. and  that  you  retain  no  copies,  including  copies  stored  on  a
  88. computer.

  91. D. Multiple Environment Software/Multiple Language Software/Dual
  92. Media Software/Multiple Copies

  94. If the Software includes, or, in connection with the  acquisition  of
  95. the Software you receive, two or more operating environment  versions
  96. of the Software (e.g. OS/2(R) and Windows(TM)), two or more  language
  97. translation versions of the Software, the same  Software  on  two  or
  98. more media (e.g., diskettes  and  a  CD-ROM),  and/or  you  otherwise
  99. receive two or more copies  of  the  Software,  the  total  aggregate
  100. number of computers on which all versions of the  Software  are  used
  101. may not exceed the Permitted Number of Computers. You  may  make  one
  102. back-up copy, in accordance with the terms  of  this  Agreement,  for
  103. each version of the Software  you  use.  You  may  not  rent,  lease,
  104. sublicense, lend or transfer versions or copies of the  Software  you
  105. do not use, or Software contained on  any  unused  media,  except  as
  106. part of the permanent transfer of all Software and  Documentation  as
  107. described above.

  110. E. Limited  Warranty

  112. H&H Software Vertrieb GbR warrants to  you  that  the  Software  will
  113. perform substantially in accordance with the  Documentation  for  the
  114. sixty (60) day period following your  receipt  of  the  Software.  To
  115. make a warranty claim, you must return the Software to  the  location
  116. where you obtained it along with a copy of your sales receipt  within
  117. such sixty  (60)  day  period.  If  the  Software  does  not  perform
  118. substantially in accordance with the Documentation,  the  entire  and
  119. exclusive liability and remedy shall be limited  to  either,  at  H&H
  120. Software Vertrieb GbR's option, the replacement of  the  Software  or
  121. the refund of the license fee you paid for the Software.
  122. H&H SOFTWARE VERTRIEB  GBR  AND  ITS  SUPPLIERS  DO  NOT  AND  CANNOT
  123. WARRANT THE PERFORMANCE OR  RESULTS  YOU  MAY  OBTAIN  BY  USING  THE
  124. SOFTWARE  OR  DOCUMENTATION.  THE  FOREGOING  STATES  THE  SOLE   AND
  125. EXCLUSIVE  REMEDIES  FOR  H&H  SOFTWARE  VERTRIEB  GBR'S  BREACH   OF
  126. WARRANTY. EXCEPT FOR THE FOREGOING  LIMITED  WARRANTY,  H&H  SOFTWARE
  127. VERTRIEB  GBR  MAKE  NO  WARRANTIES,  EXPRESS  OR  IMPLIED,   AS   TO
  128. NONINFRINGEMENT OF THIRD PARTY RIGHTS,  MERCHANTABILITY,  OR  FITNESS
  129. FOR ANY PARTICULAR PURPOSE. IN NO EVENT WILL  H&H  SOFTWARE  VERTRIEB
  130. GBR BE LIABLE TO YOU FOR ANY  CONSEQUENTIAL,  INCIDENTAL  OR  SPECIAL
  131. DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF  AN  H&H
  132. SOFTWARE GBR REPRESENTATIVE HAS BEEN ADVISED OF  THE  POSSIBILITY  OF
  133. SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.
  134. Some  states  or  jurisdictions  do  not  allow  the   exclusion   or
  135. limitation of incidental, consequential or special  damages,  or  the
  136. exclusion of  implied  warranties  or  limitations  on  how  long  an
  137. implied warranty may last, so the above limitations may not apply  to
  138. you. To the extent permissible, any implied  warranties  are  limited
  139. to sixty (60) days. This warranty gives you  specific  legal  rights.
  140. You may  have  other  rights  which  vary  from  state  to  state  or
  141. jurisdiction  to  jurisdiction.  For  further  warranty  information,
  142. please  contact  H&H  Software  Vertrieb   GbR's   Customer   Support
  143. Department.

  146. F. Renunciation
  147.  
  148. Neither  the  authors,  H  &  H  Software  Vertrieb  GbR,   nor   any
  149. Distributor is to be held liable for any damages  of  any  kind  from
  150. the use or abuse of this program or its associated products.  Neither
  151. the authors nor  any  distributor  is  responsible  for  any  damages
  152. caused by unauthorised changes  to  the  program  or  its  associated
  153. products.
  154. There is no warranty on Unprotect or anything which is included  with
  155. it. The sole remedy for any  malfunctions  of  Unprotect  or  damages
  156. caused by such are limited to a refund of the cost of the program.
  157. Furthermore H & H Software Vertrieb GbR reserves  itself  the  right,
  158. to revise this contribution and from time to  time  make  changes  of
  159. the program without any obligation of H & H Software Vertrieb GbR  to
  160. inform a person or organization of such changes.
