  1. Software License Agreement for HyperCam.
  2.  
  3. This is a legal agreement between you and Hyperionics Technologies, Inc.  
  4. covering your use of HyperCam (the "Software").  Be sure to read the 
  5. following agreement before using the Software.  BY USING THE SOFTWARE 
  6. (REGARDLESS IF YOU HAVE REGISTERED THE SOFTWARE OR NOT), 
  7. YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
  8. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT
  9. USE THE SOFTWARE AND DESTROY ALL COPIES IN YOUR POSSESSION.

  11. The Software is owned by Hyperionics Technology, LLC and is protected by 
  12. United States copyright laws and international treaty provisions.  
  13. Therefore, you must treat the Software like any other copyrighted material 
  14. (e.  g., a book or musical recording).  Paying a single user license fee 
  15. allows you the right to use one copy of the Software on a single computer.  
  16. You may not network the Software or otherwise use it or make it available 
  17. for use on more than one computer at the same time.  Corporate customers 
  18. with multi-user network licenses should undertake a reasonable effort to 
  19. make sure that the total number of concurrent users within their 
  20. organization does not exceed their license user limit.  You may not rent 
  21. or lease the Software, nor may you modify, adapt, translate, reverse 
  22. engineer, decompile, or disassemble the Software.  If you violate any part 
  23. of this agreement, your right to use this Software terminates 
  24. automatically and you must then destroy all copies of the Software in your 
  25. possession.

  27. The Software and its related documentation are provided "AS IS" and 
  28. without warranty of any kind and Hyperionics Technology expressly 
  29. disclaims all other warranties, expressed or implied, including, but not 
  30. limited to, the implied warranties of merchantability and fitness for a 
  31. particular purpose.  Under no circumstances shall Hyperionics Technology 
  32. be liable for any incidental, special, or consequential damages that 
  33. result from the use or inability to use the Software or related 
  34. documentation, even if Hyperionics Technology has been advised of the 
  35. possibility of such damages.  In no event shall Hyperionics Technology' 
  36. liability exceed the license fee paid, if any.  
  37.  
  38. This Agreement shall be governed by the laws of the State of Pennsylvania.  
  39. If for any reason a court of competent jurisdiction finds any provision of 
  40. the Agreement, or portion thereof, to be unenforceable, that provision of 
  41. the Agreement shall be enforced to the maximum extent permissible so as to 
  42. effect the intent of the parties, and the remainder of this Agreement 
  43. shall continue in full force and effect.

  45. The Software and documentation is provided with RESTRICTED RIGHTS.  Use, 
  46. duplication, or disclosure by the Government is subject to restrictions as 
  47. set forth in subdivision (b)( 3)( ii) of the ASPR Rights in Technical Data 
  48. and Computer Software clause as 252.  227- 7013.  Manufacturer is:
