  3. THIS IS A SOFTWARE LICENSE AGREEMENT BETWEEN YOU (AN INDIVIDUAL) AND APACHE SOFTWARE CONSULTING INC. (THE COMPANY)

  5. APACHE SOFTWARE CONSULTING INC. IS LICENSING THE ENCLOSED SOFTWARE TO YOU ONLY IF YOU EXPLICITLY AGREE TO ALL THE TERMS AND CONDITIONS SPECIFIED IN THIS LICENSE AGREEMENT.

  7. PLEASE READ THIS LICENCE AGREEMENT CAREFULLY BEFORE USING THE ENCLOSED SOFTWARE.

  9. BY USING THE ENCLOSED SOFTWARE YOU AGREE TO ALL TERMS AND CONDITIONS OF THIS LICENCE AGREEMENT.

  11. IF YOU DO NOT AGREE TO ALL TERMS AND CONDITIONS OF THIS LICENCE AGREEMENT YOU ARE REQUIRED TO UNINSTALL AND REMOVE THE ENCLOSED SOFTWARE FROM YOUR COMPUTER.

  13. Commercial Use
  14. --------------------
  15. The enclosed software is licensed for non-commercial use only. Commercial users are entitled to a 30-day trial of the enclosed software, after which they are required to uninstall the enclosed software and remove it from their computers. To continue usage after the 30-day trial period, commercial users must purchase licenses. Please contact Apache Software Consulting Inc. for details on how to purchase commercial licenses. During the 30 day trial period, commercial users are bound to this Software Licence Agreement.

  17. Grant of License
  18. ----------------
  19. This Software License Agreement entitles you to use the enclosed software on a single computer, provided that you are the only individual using the software. You are also entitled to make one backup copy of the enclosed software in the form provided to you by the Company.

  21. Restrictions of use
  22. -------------------
  23. The enclosed software contains copyrighted and otherwise proprietary materials, trade secrets, which are the property of Apache Software Consulting Inc. and other companies (it's licensors). The enclosed software is provided in a computer readable format. You agree that in no way you will attempt to disassemble, decompile, reverse engineer or otherwise revert the enclosed software or part of to a human-readable form.
  24. You agree that you may not modify, loan, or distribute the enclosed software or part of in any way possible. You agree that you may not create derivative works based on the enclosed software or part of.

  26. Ownership

The enclosed software is owned in whole by Apache Software Consulting Inc. and is only licensed to you according to the terms and conditions of this Software License agreement. Apache Software Consulting Inc. reserves all other rights not explicitly expressed in this Software License Agreement

  30. Security
  31. --------
  32. This section refers to information exchange over a network. The enclosed software might send and receive information over networks on your behalf as a result of your interaction. The information sent and received over networks is deemed unsecure. You agree that the information sent and received by the enclosed software on your behalf is unsecure and can be intercepted by malicious third-parties unless explicitly stated otherwise.

  34. Disclaimer of Warranty

  36. THE ENCLOSED SOFTWARE IS PROVIDED TO YOU AS IS, WITH NO WARRANTY OF ANY KIND. YOU AGREE THAT YOUR USE OF THE ENCLOSED SOFTWARE IS AT YOUR OWN RISK.

  38. Limitation of Liability

  40. UNDER NO CIRCUMSTANCES WILL APACHE SOFTWARE CONSULTING INC. OR IT'S LICENSORS BE LIABLE FOR DAMAGES OF ANY KIND OCCURRING AS A RESULT OF USING THE ENCLOSED SOFTWARE.

  42. THIS SOFTWARE LICENCE AGREEMENT CONSTITUES THE ENTIRE LICENSE AGREEMENT BETWEEN THE PARTIES WITH RESPECT TO THE USE OF THE ENCLOSED SOFTWARE.
