  6. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND L0PHT HEAVY INDUSTRIES
  7. ("L0PHT"). CAREFULLY READ ALL THE TERMS AND CONDITIONS OF THIS
  8. AGREEMENT PRIOR TO USING THE SOFTWARE. BY USING THE SOFTWARE YOU
  9. CONSENT TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT

  29. 1.TITLE AND OWNERSHIP. The Software is owned by L0pht Heavy 
  30. Industries, Inc. The Software is protected by United States 
  31. and international copyright and other laws. You may not remove, 
  32. obscure, or alter any notice of patent, copyright, trademark, 
  33. trade secret, or other proprietary rights. You may not reverse 
  34. engineer, disassemble or de-compile the Software nor may you 
  35. permit anyone else to do so.

  37. This license and your right to use the Software terminate 
  38. automatically if you violate any part of this Agreement.

  40. 3.DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY.
  41. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY
  42. OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WITHOUT
  43. LIMITATION, L0PHT DISCLAIMS ALL IMPLIED
  44. WARRANTIES WITH RESPECT TO THE SOFTWARE, ITS
  45. MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR
  46. PURPOSE. YOU ASSUME ALL RISK IN USING THE SOFTWARE.
  47. IN NO EVENT WILL L0PHT BE LIABLE FOR INDIRECT,
  48. INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING,
  49. WITHOUT LIMITATION, LOSS OF INCOME, LOSS OF USE, OR
  50. LOSS OF INFORMATION. IN NO EVENT WILL L0PHT BE
  51. LIABLE FOR ANY DAMAGES, EVEN IF L0PHT SHALL HAVE
  52. BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES
  53. OR FOR ANY CLAIM BY ANY OTHER PARTY. CERTAIN STATES
  54. DO NOT PERMIT EXCLUSIONS OF IMPLIED WARRANTIES OR
  55. LIMITATIONS OF LIABILITY, SO THIS DISCLAIMER MAY NOT
  56. APPLY TO YOU OR MAY APPLY TO YOU ONLY IN PART. YOU
  57. MAY HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE

  60. 4.EXPORT COMPLIANCE. You may not export or reexport the
  61. Software except in full compliance with all United States and 
  62. other applicable laws and regulations, including laws and 
  63. regulations pertaining to the export of computer software.

  65. 5.GENERAL. This Agreement constitutes the entire agreement between
  66. you and L0PHT and supersedes any prior written or oral agreement
  67. concerning the Software. It shall not be modified except by 
  68. written agreement dated subsequent to the date of this Agreement 
  69. and signed by an authorized L0PHT representative. L0PHT is not 
  70. bound by any provision of any purchase order, receipt, acceptance, 
  71. confirmation, correspondence, or otherwise, unless L0PHT 
  72. specifically agrees to the provision in writing. This Agreement 
  73. is governed by the laws of the State of Massachusetts as if the 
  74. parties hereto were both Massachusetts residents; and you consent
  75. to exclusive jurisdiction in the state and federal courts 
  76. in Boston in the event of any dispute.

  78. 6.U.S. GOVERNMENT RESTRICTED RIGHTS. The Software is
  79. provided with RESTRICTED RIGHTS. Use, duplication, or disclosure
  80. by the Government is subject to restrictions as set forth in
  81. subparagraph (c)(1)(ii) of the Rights in Technical Data and 
  82. Computer Software clause at DFARS 252.227-7013 or 
  83. subparagraphs (c)(1) and (2) of the Commercial Computer Software 
  84. Restricted Rights at 48 CFR 52.227-19, as applicable.
