  1. Conditions (terms) for the use of the archive/CD-ROM

  4. This document containts copyright, warranty and other information
  5.  
  6. The Peanuts-FTP-Archiv (also known as 'Peanuts'), located at the
  7. Ludwig Maximilian University in Munich, renders accessible documents 
  8. in the archive available for public use by electronic means and on CD-ROM.
  9.  
  10. Such documents  are among others News-Contributions, Documents of third party
  11. or software taken in charge for redistribution of a third party software supplier.
  12.  
  13. The expression "Software" also includes the associated documentation.
  14. Access to the documents in these archives is free of charge in case of
  15. non-commercial use.
  16.  
  17. Access to these archives can be made by means of services and information
  18. systems such as ftp, email, gopher, www and on CD-ROM.

  20. By consulting the archive or copying documents the user acknowledges the
  21. legality of the following conditions:

  24. 1. The documents are subject to different licence and copyright regulations. 
  25.    As far as no particular regulation is indicated, the documents
  26.    - mainly the software-  are not (available) in the 'Public Domain' .
  27.    The user acknowledges and agrees that the software is copyrighted and
  28.    protected under the copyright law.
  29.    The copyrights remain with the authors respectively with the indicated
  30.    Institutions - also if the software bears no copyright note.
  31.    Existing copyright notes must not be changed or omitted.

  33.    With the purchase of the CD-ROM version, the user obtains no
  34.    additional rights.
  35.    Especially with the use of so known 'shareware' software, the
  36.    user still has to pay the shareware amount to the owner of the
  37.    shareware software.

  39. 2. Passing documents to third persons presumes, that these persons
  40.    previously were informed about and are liable for compliance of the
  41.    regulations.

  43. 3. The documents (in particular software and its documentation) are not
  44.    guarenteed to be examined; they are unexamined placed at disposal, with
  45.    no warranty for completeness, perfection or suitability for whatever
  46.    purposes.
  47.    It can not be guaranteed that the software is free of 'Viruses','worms',
  48.    however we do out best to detect them and desinfect the software
  49.  
  50. 4. Messages about the occurence of software errors, their removal and the
  51.    realization of proposed updates can not be ensured.

  53. 5. Neither the authors nor the Department of Computer Science nor the 
  54.    Ludwig Maximilian University, Munich are liable for any direct, indirect,
  55.    special, incidental or consequential damages based on the use 
  56.    of the archives and their products.

  58. 6. Neither the executive producer, producer, distributor of the CD-ROM, nor 
  59.    administrators nor any other person related to the Peanuts-FTP-Archive,
  60.    can be made liable for any damage caused by the usage of documents or
  61.    software available on the archive.

  63. 7. Users of the archive are not allowed to produces copies in whole or in
  64.    part of the archive and its structure, especially on CD-ROM or other
  65.    mass medium. The administrators will permit the copying in special cases
  66.    in written form. The active administrators are noted on the web-pages
  67.    of the archive (http://www.peanuts.org/). Users are allowed to produce
  68.    copies for their personal use only.

  70. 8. The remedies (laws) of the Federal Republic of Germany are valid, forum
  71.    is Munich.

  73. 9. If one of the above mentioned regulations becomes inoperative, the validity
  74.    of the residual conditions (terms) remains unaffected. Invalid conditions
  75.    are automatically replaced by conditions which will come most close the
  76.    the invalid condition.

  78. 10.These terms are valid until new terms are published. The active terms

  82. 11.In case of misunderstandings or translation errors, the german version 
  83.    of this document overrides the english version.
