  5. USING IBM techexplorer Hypermedia Browser (the "SOFTWARE").
  6. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE
  7. THE SOFTWARE.

  9. NOTICE:  The Software is not released for general
  10. availability and may be modified substantially before such
  11. release.  The Software may not be at a level of performance
  12. or compatibility of general available IBM products.  In
  13. addition, IBM does not guarantee that the Software will ever
  14. be released for general availability.  ANY APPLICATION
  15. PROGRAMS PROCESSED OR COMPILED WITH THE SOFTWARE DURING THE
  16. EVALUATION PERIOD MAY NOT REMAIN OPERATIONAL WITH THE
  17. SOFTWARE IF IT IS RELEASED FOR GENERAL AVAILABILITY.

  19. 1.  Ownership and License.

  21. The Software is owned by International Business Machines
  22. Corporation or one of its subsidiaries ("IBM") or an IBM
  23. supplier and is copyrighted and licensed, not sold.  The
  24. Software consists of machine-readable instructions,
  25. audio/visual content (such as software documentation) and
  26. related licensed materials.

  28. IBM grants you free of charge a non-exclusive,
  29. non-transferable license to download the Software and use it
  30. on a reasonable number of  client machines for purposes of
  31. testing and evaluation only. The Software is not to be used
  32. for production purposes.

  34. You may copy the Software for backup.  You may not:  1)
  35. copy, merge, distribute, sublicense, lease, or rent the
  36. SOFTWARE except as specifically permitted by this Evaluation
  37. License; 2) reverse assemble, reverse compile, or otherwise
  38. translate the Software except as specifically permitted by
  39. law without the possibility of contractual waiver.

  41. 2. Term and Termination

  43. IBM may terminate this Evaluation License, with or without
  44. cause, by providing notice to you.  You may terminate this
  45. Evaluation License at any time by deleting or destroying all
  46. copies of the Software and documentation.  Unless either
  47. party terminates this License at an earlier date, your
  48. license to the Software expires on its release for general
  49. availability.

  51. 3.  Warranty Disclaimer and Limitation of Liability

  54. IBM licenses the Software to you on an "AS IS" basis,
  55. without warranty of any kind.  IBM HEREBY EXPRESSLY
  56. DISCLAIMS ALL WARRANTIES OR CONDITIONS, EITHER EXPRESS OR
  57. IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
  58. WARRANTIES OR CONDITIONS OF MERCHANTABILITY  AND FITNESS FOR
  59. A PARTICULAR PURPOSE.  The entire risk arising from use of
  60. the Software remains with you. Some jurisdictions do not
  61. allow for the exclusion or limitation of implied
  62. warranties, so the above limitations or exclusions may not
  63. apply to you.

  65. IBM WILL NOT BE LIABLE FOR ANY DIRECT DAMAGES OR FOR ANY
  66. SPECIAL, INCIDENTAL, OR  INDIRECT DAMAGES OR FOR ANY
  67. ECONOMIC CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR
  68. SAVINGS), EVEN IF IBM, OR ITS DISTRIBUTOR, HAS BEEN ADVISED
  69. OF THE POSSIBILITY OF SUCH DAMAGES.  IBM will not be liable
  70. for the loss of, or damage to, your records or data, or any
  71. damages claimed by you based on a third party claim.  Some
  72. jurisdictions do not allow for the exclusion or limitation
  73. of incidental or consequential damages, so the above
  74. limitations or exclusions may not apply to you.

  76. 4.  General

  78. If you acquire the Software in the United States, this
  79. license is governed by the laws of the State of New York.
  80. If you acquire the Software in Canada, this license is
  81. governed by the laws of the Province of Ontario.  Otherwise
  82. this license is governed by the laws of the country in which
  83. you acquire the Software.
  84.  
  85. This Evaluation License is the only understanding and
  86. agreement we have regarding your use of the Software.  It
  87. supersedes all other communications, understandings or
  88. agreements we may have had prior to this evaluation license.
  89.  
  90. After installing the Software, you can view or print a copy
  91. of this Evaluation License from the file NOTICES.TXT in the
  92. directory where you installed the Software.
