- This file provides information for Electronic Board
- Systems or BBS's, computer clubs, user groups and
- vendors such as catalog vendors,CDROM distributors,
- rack or retail outlet vendors, or anyone who plans
- to distribute Storymaker+ VGA on a shareware basis.
-
- Storymaker+ comes in two versions, the original ver-
- sion for the EGA and this version for the VGA. The
- two versions are different programs. Distribution
- terms of one version apply specifically only to that
- version and the terms may be different.
-
- A common definition of a shareware program is that
- it is a "try-before-you-buy, low cost, high quality
- software". Storymaker+ VGA release for shareware
- distribution is under this definition, not as a pub-
- lic domain, freeware or user-voluntarily-supported
- product. That it is a indeed low cost, high quality
- software is something that users can examine for
- themselves, so the only question is how to responsi-
- bly put it in the shareware distribution channels as
- indeed a try-before-you-buy product.
-
- As the author feels uncomfortable imposing a legal
- obligation on users to register a product distribu-
- ted under shareware's system of wide and free dis-
- tribution without adding in it something to support
- the legal limitations on its use, it was considered
- to release a limited - or crippled - version in sup-
- port of or in place of legal requirements. However
- although the author considers limited use as a good
- method to support the try-before-you-buy condition
- of shareware, Storymaker+ VGA numerous features make
- it difficult to decide what kind of limitations will
- serve its purpose without making the program run
- like a demoware. It was therefore decided not to put
- any limitations on the software's functions so as
- not to hinder in any way a sufficient evaluation and
- appreciation of the product. A personal obligation
- to register is also imposed on the user in place of
- a legal obligation.
-
- As the author then has to rely directly on the users
- only once they acquire the product, it is important
- it reaches them clean, so to speak. And the author
- recognizes that the manner of distribution does play
- a real and very important role in the public's per-
- ception of and regard for shareware products and do
- appreciate the contribution of those who truly pro-
- mote shareware as shareware for helping distribute
- Storymaker+.
-
- There is that old saying that goes something like
- "If I don't do it, someone else will, so it might as
- well be me." As the author does not care if some-
- body else will (otherwise, there's always a red light
- to ignore), the author also does not care about the
- argument that any form of distribution is all right
- as long as it gets the program around and generates
- registrations. So adherence to the following terms
- of the limited license to distribute is entirely
- conditioned on the author's wishes on how the pro-
- duct should be distributed; if that system fails to
- serve the author's interest, so be it and those who
- feel they can not comply with the terms should not
- distribute Storymaker+ VGA:
-
- 1. The author does not make arrangement for any com-
- pensation from the shareware distribution of the
- product and in determining fair use, relies on a
- reasonable perception of the intent of anyone
- distributing the product.
-
- 2. No files in the product may be omitted, renamed
- or modified in any way. Distributors may add
- files that are component parts of their distribu-
- tion package on the condition that the files must
- clearly state it is not part of the original
- package.
-
- 3. As the distribution terms are meant to apply to
- how the product is distributed and not to what
- users do after acquiring the product, it is the
- responsibility of the distributor to promote the
- product as shareware and this includes protecting
- the interests of the product's developer.Any form
- of distribution promotion that directly or indi-
- rectly encourages free use of the product, spe-
- cially after any payment to the distributor, is
- unfair use of the product, will be considered an
- attempt to deprive rightful income from its deve-
- loper and is therefore strictly prohibited.
-
- 4. The product may be freely uploaded to BBSs' for
- traditional shareware distribution.
-
- 5. As the software has low registration fee, it is
- expected that any distribution fee, including in-
- cidental charges, will be reasonable, reflecting
- the shareware nature of the product and the fact
- that no compensation is made to its producer.
-
- 6. Rack shareware distributors must first obtain
- written authorization before selling the product,
- providing the author necessary information in
- order to determine compliance with the distribu-
- tion terms. Failure to do so will subject the
- package to immediate withdrawal from the market.
-
- 7. Other distributors who also plan to do special
- packaging or selling of the product must also
- consider obtaining prior written authorization as
- a precaution if common reason tells them they may
- need to do so. This does not apply to traditional
- catalog sales or the like.
-
- 8. Distributors must take into account in their
- inventory and distribution plans that the product
- is subject to periodic revisions and updates and
- must use the latest version whenever reasonably
- possible.
-
- 9. The author reserves the right to revoke permi-
- ssion from anyone to distribute the product.
