  1. Software License Agreement
  2.  
  3. "Unregistered Software" refers to any copy of this software program for which
  4. you have not received Registration details from the author or Kagi Shareware;
  5. "Registered Software" refers to any copy of this software program for which you
  6. have received Registration details from the author or Kagi Shareware.
  7. "Registered Users" are users of the Registered Software who have received
  8. Registration details from the author or Kagi Shareware. "Registration details"
  9. are a user name and number provided by the author or Kagi Shareware in return
  10. for payment or other consideration.

  12. License.

  14. Under the terms of this license you may:

  16. 1.1. Use the Unregistered Software on any number of computers at any one time;
  17. and

  19. 1.2. Copy and distribute verbatim copies of the Unregistered Software
  20. Distribution as you receive it, in any medium, provided that you do not modify
  21. it any fashion, keep intact all the notices that refer to this License and to
  22. the absense of any warranty, and do not pass on any User Registration details
  23. which you have received. If you distribute copies of this software, you shall
  24. not charge anything except the cost of the media and a fair estimate of the
  25. costs of computer time or network time directly attributable to the copying.

  27. 1.3. In addition, Registered Users may use one copy of the Registered Software
  28. on only a single computer at any one time.

  30. The Registered Software is "in use" when it is loaded into random access memory
  31. or installed on a hard disk or other storage device (other than a network
  32. server). Installing the Registered Software on a network server solely for the
  33. purpose of internally distributing the Registered Software shall not constitute
  34. "in use", provided that you have a license for each computer to which the
  35. Registered Software is distributed. If the number of users of the Registered
  36. Software is reasonably anticipated to exceed the number of corresponding
  37. licenses, you shall ensure that the number of concurrent users does not exceed
  38. the number of licenses.

  40. You shall not:

  42. 2.1. Use, copy, modify, translate or merge the Software except as provided in
  43. this agreement;

  45. 2.2. Reverse-engineer, dissemble, or decompile the Software;
  46.  
  47. 2.3. Sublicense, rent, lease, or assign any portion of the Software;
  48.  
  49. 2.4. Transfer the Software to any other party except as provided for in section
  50. 1.2; or
  51.  
  52. 2.5. Transfer Registration details to any other party without the express
  53. permission of the author in writing.

  55. Copyright.
  56.  
  57. The Software is owned by the author and is protected by United States Copyright
  58. laws and international treaty provisions. You shall treat the Software like any
  59. copyrighted material.
  60.  
  61. Limited Warranty.

  63. Except as expressly stated herein, the Software is provided "AS IS." You shall
  64. be entirely responsible for the selection of the Software and for the
  65. installation of, use of, and results obtained from, the Software.

  67. All other warranties or conditions, either express or implied, including but not
  68. limited to implied warranties of merchantibility or fitness for a particular
  69. purpose, with respect to the Software and written materials accompanying the
  70. Software, are excluded from the license.
  71.  
  72. No liability for Consequential Damages.

  74. To the maximum extent permitted by applicable law, in no event shall the author
  75. be liable for any damages whatsoever (including, without limitation, damages for
  76. loss of profits, business interruption, loss of information, or any other
  77. pecuniary loss) arising out of the use or inability to use this software
  78. product, even if the author has been advised of the possibility of such damages.

  82. None of the Software or underlying information or technology may be downloaded
  83. or otherwise exported or re-exported (i) into (or to a national or resident of)
  84. Cuba, Iraq, Libya, Sudan, North Korea, Iran, Syria or any other country to which
  85. the U.S. has embargoed goods; or (ii) to anyone on the U.S. Treasury
  86. Department's list of Specially Designated Nationals or the U.S. Commerce
  87. Department's Table of Denial Orders.  By downloading or using the Software, you
  88. are agreeing to the foregoing and you are representing and warranting that you
  89. are not located in, under the control of, or a national or resident of any such
  90. country or on any such list.
