  33.   document.write("1.2 Unless explicitly stated otherwise, any new features that \n" );

  37.   document.write("  <strong>2 What You Can't Do Under This Licence\n" );

  47.   document.write("2.2 Harm minors in any way;\n" );

  49.   document.write("2.3 Impersonate any person or entity or falsely state or otherwise \n" );

  52.   document.write("2.4 Forge headers or otherwise manipulate identifiers in order to \n" );
  53.   document.write("disguise the origin of any data transmitted to other users;\n" );
  54.   document.write("<p class=textSml>\n" );
  55.   document.write("2.5 Transmit, access or communicate any data that you do not \n" );
  56.   document.write("have a right to transmit under any law or under contractual or \n" );
  57.   document.write("fiduciary relationships (such as inside information, proprietary \n" );
  58.   document.write("and confidential information learned or disclosed as part of \n" );
  59.   document.write("employment relationships or under non-disclosure agreements);\n" );

  61.   document.write("2.6 Transmit, access or communicate any data that infringes any \n" );
  62.   document.write("patent, trademark, trade secret, copyright or other proprietary \n" );
  63.   document.write("rights of any party;\n" );

  65.   document.write("2.7 Transmit or communicate any data that contains software \n" );
  66.   document.write("viruses or any other computer code, files or programs designed \n" );
  67.   document.write("to interrupt, destroy or limit the functionality of any computer \n" );
  68.   document.write("software or hardware or telecommunications equipment;\n" );
  69.   document.write("<p class=textSml>\n" );
  70.   document.write("2.8 Disrupt the normal flow of dialogue, cause a screen to \n" );
  71.   document.write("\"scroll\" faster than other users are able to type, or otherwise act \n" );
  72.   document.write("in a manner that negatively affects other users' ability to engage \n" );
  73.   document.write("in real time exchanges;\n" );
  74.   document.write("<p class=textSml>\n" );
  75.   document.write("2.9 Interfere with or disrupt the Software;\n" );
  76.   document.write("<p class=textSml>\n" );
  77.   document.write("2.10 Intentionally or unintentionally violate any applicable local, \n" );
  78.   document.write("state, national or international law, including securities exchange \n" );
  79.   document.write("and any regulations requirements, procedures or policies in force \n" );
  80.   document.write("from time to time relating to the Software;\n" );
  81.   document.write("<p class=textSml>\n" );
  82.   document.write("2.11 Monitor traffic or make search requests in order to \n" );
  83.   document.write("accumulate information about individual users;\n" );
  84.   document.write("<p class=textSml>\n" );
  85.   document.write("2.12 \"Stalk\" or otherwise harass another;\n" );
  86.   document.write("<p class=textSml>\n" );
  87.   document.write("2.13 Modify, delete or damage any information contained on the \n" );
  88.   document.write("personal computer of any Kazaa Media Desktop user; or\n" );
  89.   document.write("<p class=textSml>\n" );
  90.   document.write("2.14 Collect or store personal data about other users.\n" );
  91.   document.write("<p class=textSml>\n" );
  92.   document.write("  <strong>3 More Do's and Don'ts\n" );
  93.   document.write("  </strong>\n" );
  94.   document.write("<p class=textSml>\n" );
  95.   document.write("3.1 This Licence allows you to install and use the Kazaa Media \n" );
  96.   document.write("Desktop on a single computer. This Licence does not permit you \n" );
  97.   document.write("to install the Software on more than one computer at a time. You \n" );
  98.   document.write("may make copies of the Software in machine-readable form for \n" );
  99.   document.write("backup purposes only. The backup copy must include all \n" );
  100.   document.write("copyright information contained on the original.\n" );

  102.   document.write("3.2 Except as expressly permitted in this Licence, you agree not \n" );
  103.   document.write("to reverse engineer, de-compile, disassemble, alter, duplicate, \n" );

  105.   document.write("derivative works from, distribute or provide others with the \n" );

  109.   document.write("3.3 You may not sell, transfer or communicate the Software to \n" );

  112.   document.write("  <strong>4 Things You Need To Know When Using The Kazaa Media \n" );
  113.   document.write("Desktop\n" );
  114.   document.write("  </strong>\n" );
  115.   document.write("<p class=textSml>\n" );
  116.   document.write("4.1 You are responsible for paying all applicable taxes and other \n" );
  117.   document.write("costs you may incur in connection with your use of the Software \n" );
  118.   document.write("including but not limited to all hardware and software costs and \n" );
  119.   document.write("providing all equipment and software necessary to connect to \n" );
  120.   document.write("our web site and to use the Software via the Internet and any \n" );
  121.   document.write("royalties or other charges relating to the use of data owned by \n" );
  122.   document.write("third parties.\n" );
  123.   document.write("<p class=textSml>\n" );
  124.   document.write("4.2 Sharman may from time to time present programming fixes, \n" );
  125.   document.write("updates and upgrades to you, including version updates to the \n" );
  126.   document.write("Software. You may accept or reject such programming fixes, \n" );
  127.   document.write("updates and upgrades to you, including version updates at your \n" );
  128.   document.write("sole discretion.\n" );
  129.   document.write("<p class=textSml>\n" );
  130.   document.write("4.3 Installation. When you install the Software, the install \n" );
  131.   document.write("program, e.g. kmd250_en.exe, is saved to your My Shared \n" );
  132.   document.write("Folder and shared out to other users. You understand and agree \n" );
  133.   document.write("that other users may download this file from your computer and \n" );
  134.   document.write("by doing so your Internet connection will be used. If you do not \n" );
  135.   document.write("want this to happen, you can delete the file or right click the file \n" );
  136.   document.write("and select 'Do Not Share This File'.\n" );
  137.   document.write("<p class=textSml>\n" );
  138.   document.write("4.4 My Shared Folder. By saving a file in My Shared Folder, \n" );
  139.   document.write("you understand that it will be available for any other user of \n" );
  140.   document.write("Kazaa Media Desktops and compatible programs. These users \n" );
  141.   document.write("may find your files and subsequently download them from you. \n" );
  142.   document.write("By doing so your Internet connection is being used. The \n" );
  143.   document.write("Software provides options regarding sharing:<p class=textSml>\n" );
  144.   document.write("* To disable sharing go to Tools->Options->Traffic and check \n" );
  145.   document.write("Disable Sharing <br>\n" );
  146.   document.write("* To disable sharing of selected files right click the file in My \n" );
  147.   document.write("Kazaa and select Stop Sharing this file\n" );
  148.   document.write("<p class=textSml>\n" );
  149.   document.write("The Kazaa Media Desktop program is a \"peer-to-peer\" program; \n" );
  150.   document.write("this means that it communicates with other peers (other Kazaa \n" );
  151.   document.write("Media Desktops or compatible programs). Other users may \n" );
  152.   document.write("download files that you have stored in the My Shared Folder and \n" );
  153.   document.write("other folders you have selected to be shared.  Don't share files \n" );
  154.   document.write("which are confidential, such as financial information, or which \n" );
  155.   document.write("you do not have the right to distribute. \n" );
  156.   document.write("<p class=textSml>\n" );
  157.   document.write("While your instance of Kazaa Media Desktop is communicating \n" );
  158.   document.write("with other peers it receives information of the status of \n" );
  159.   document.write("interconnected peers, that information is stored on your \n" );
  160.   document.write("computer. \n" );
  161.   document.write("<p class=textSml>\n" );
  162.   document.write("4.5 SuperNode. Your copy of the Software may serve as a \n" );
  163.   document.write("SuperNode. The selection process is automated. When your \n" );
  164.   document.write("computer is a SuperNode other peers will upload an index of \n" );
  165.   document.write("files they are sharing to your computer and they will send search \n" );
  166.   document.write("queries to your computer. Your computer will reply to these \n" );
  167.   document.write("requests and also forward the request to other SuperNodes. \n" );
  168.   document.write("<p class=textSml>\n" );
  169.   document.write("If you do not want to serve as a SuperNode go to Tools -> \n" );
  170.   document.write("Options -> Advanced and check 'Do not function as a \n" );
  171.   document.write("SuperNode'. When you are a SuperNode your CPU and Internet \n" );
  172.   document.write("connection is being used, but not more than 10% of the \n" );
  173.   document.write("resources will be used.\n" );
  174.   document.write("<p class=textSml>\n" );
  175.   document.write("  <strong>5 Things You Need To Do When Using The Kazaa Media \n" );
  176.   document.write("Desktop\n" );
  177.   document.write("  </strong>\n" );
  178.   document.write("<p class=textSml>\n" );
  179.   document.write("5.1 It is your responsibility to ensure that you obtain all \n" );
  180.   document.write("consents, authorisations and clearances in any data owned or \n" );
  181.   document.write("controlled by third parties that you transmit, access or \n" );
  182.   document.write("communicate to others using the Kazaa Media Desktop. \n" );
  183.   document.write("<p class=textSml>\n" );
  184.   document.write("5.2 Sharman will not be liable in any way:\n" );
  185.   document.write("<p class=textSml>\n" );
  186.   document.write("5.2.1 for any errors or omissions in any data, or for any loss or \n" );
  187.   document.write("damage of any kind incurred as a result of any data transmitted \n" );
  188.   document.write("via the Software;\n" );
  189.   document.write("<p class=textSml>\n" );
  190.   document.write("5.2.2 if you are exposed to data that is offensive, indecent or \n" );
  191.   document.write("objectionable; or\n" );
  192.   document.write("<p class=textSml>\n" );
  193.   document.write("5.2.3 for any allegations or findings of infringement of copyright \n" );
  194.   document.write("or other proprietary rights as a result of your use of the \n" );
  195.   document.write("Software.\n" );
  196.   document.write("<p class=textSml>\n" );
  197.   document.write("  <strong>6 Copyright Infringement\n" );
  198.   document.write("  </strong>\n" );
  199.   document.write("<p class=textSml>\n" );
  200.   document.write("6.1 Sharman respects copyright and other laws. Sharman \n" );
  201.   document.write("requires all Kazaa Media Desktop users to comply with \n" );
  202.   document.write("copyright and other laws. Sharman does not by the supply of the \n" );
  203.   document.write("Software authorise you to infringe the copyright or other rights \n" );
  204.   document.write("of third parties.\n" );
  205.   document.write("<p class=textSml>\n" );
  206.   document.write("6.2 As a condition to use the Software, you agree that you must \n" );
  207.   document.write("not use the Software to infringe the intellectual property or other \n" );
  208.   document.write("rights of others, in any way. The unauthorised reproduction, \n" );
  209.   document.write("distribution, modification, public display, communication to the \n" );
  210.   document.write("public or public performance of copyrighted works is an \n" );
  211.   document.write("infringement of copyright.\n" );
  212.   document.write("<p class=textSml>\n" );
  213.   document.write("6.3 Users are entirely responsible for their conduct and for \n" );
  214.   document.write("ensuring that it complies with all applicable copyright and data-\n" );
  215.   document.write("protection laws. In the event a user fails to comply with laws \n" );
  216.   document.write("regarding copyrights or other intellectual property rights and \n" );
  217.   document.write("data-protection and privacy, such a user may be exposed to civil \n" );
  218.   document.write("and criminal liability, including possible fines and jail time.\n" );

  220.   document.write("  <strong>7 Sharman's Right to Run Advertising without Payment to \n" );

  224.   document.write("7.1 Sharman reserves the right to run advertisements and \n" );
  225.   document.write("promotions on the Kazaa Media Desktop. \n" );

  227.   document.write("7.2 By accepting the terms of this Licence, you agree that we \n" );
  228.   document.write("have the right to run such advertisements and promotions \n" );
  229.   document.write("without compensation to you.\n" );

  231.   document.write("7.3 The timing, frequency, placement and extent of advertising \n" );
  232.   document.write("by us within the pages comprising kazaa.com or the Kazaa \n" );
  233.   document.write("Media Desktop is subject to change and shall be determined by \n" );
  234.   document.write("us at our sole discretion.\n" );

  236.   document.write("7.4 Your correspondence or business dealings with, or \n" );
  237.   document.write("participation in promotions of, advertisers found on or through \n" );
  238.   document.write("the Kazaa web site or Kazaa Media Desktop, including payment \n" );
  239.   document.write("and delivery of related goods or services, and any other terms, \n" );
  240.   document.write("conditions, warranties or representations associated with such \n" );
  241.   document.write("dealings, are solely between you and such advertiser.\n" );
  242.   document.write("<p class=textSml>\n" );
  243.   document.write("7.5 You agree that Sharman is not responsible or liable for any \n" );
  244.   document.write("loss or damage of any sort incurred as the result of any such \n" );
  245.   document.write("dealings or as the result of the presence of such advertisers on \n" );
  246.   document.write("the Kazaa Media Desktop and/ or the Kazaa web site.\n" );

  249.   document.write("  <strong>8 Links to Third-Party Sites and Channels\n" );

  252.   document.write("8.1 Sharman may provide links to or frame various third party web \n" );
  253.   document.write("sites or frame within such sites through the Software or on kazaa.com, \n" );
  254.   document.write("including co-branding and other relationships that offer e-commerce \n" );
  255.   document.write("and other services and features to users. Any third-party sites, \n" );
  256.   document.write("including channels, to which kazaa.com or the Kazaa Media Desktop \n" );
  257.   document.write("may link or frame are not under control of Sharman. Sharman does \n" );
  258.   document.write("not have any responsibility or liability for any information, data, \n" );
  259.   document.write("communications or materials available on such third-party sites. \n" );
  260.   document.write("These linked and framed sites are only for your convenience and \n" );
  261.   document.write("you therefore access them at your own risk.\n" );

  270.   document.write("yourself (\"Third Party Software\"), including without limitation \n" );
  271.   document.write("those software components noted in Section 9.4 below. Please \n" );
  272.   document.write("note that the Third Party Software may be subject to different \n" );
  273.   document.write("licences or other arrangements, which you should read carefully. \n" );
  274.   document.write("By installing and using this Third Party Software you accept \n" );
  275.   document.write("these Third Party Software licences or other arrangements and \n" );
  276.   document.write("acknowledge that you have read them and understand them. \n" );
  277.   document.write("Sharman does not sell, resell, or license any of this Third Party \n" );
  278.   document.write("Software, and Sharman disclaims to the maximum extent \n" );
  279.   document.write("permitted by applicable law, any responsibility for or liability \n" );
  280.   document.write("related to the Third Party Software. Any questions, complaints \n" );
  281.   document.write("or claims related to the Third Party Software should be directed \n" );

  284.   document.write("9.2 Sharman makes no representations or warranties of any kind \n" );
  285.   document.write("concerning the quality, safety or suitability of this software, \n" );

  308.   document.write("advertising delivery program, which may display web content \n" );

  310.   document.write("other value-added content. The Cydoor component uses your \n" );
  311.   document.write("Internet connection to update its selection of available ads and \n" );
