  8. By using, copying, transmitting, distributing or installing EasyImage Lite, you
  9. agree to all of the terms of this License.  If you do not agree to any of the
  10. terms of this License, then do not use, copy, transmit, distribute, or install
  11. EasyImage Lite.

  13. This is not free software.  Subject to the terms below, you are hereby licensed
  14. by Chameleon Systems, Inc. ("CSI") to use this software for evaluation purposes
  15. without charge for a period of 10 days.  If you use this software after the 10
  16. day evaluation period a registration fee of $9.95 (subject to change) is
  17. required.  Payments must be in US dollars drawn on a US bank.  See the Chameleon 
  18. Systems web site at http://www.chameleon-systems.com for information about 
  19. online ordering and price changes.

  21. Unregistered use of EasyImage Lite after the 10-day evaluation period is in
  22. violation of U.S. and international copyright laws.
  23.  
  24. You may, without making any payment to CSI:
  25.  
  26. a)    give exact copies of this evaluation version of EasyImage Lite
  27.         personally to anyone, except for the purpose of extending their
  28.     10 day evaluation period;
  29. b)    distribute exact copies of this evaluation version of EasyImage Lite, if
  30.         done exclusively through electronic channels; and
  31. c)    make as many exact copies of this evaluation version of EasyImage Lite
  32.         as you wish, for purposes of distribution as described in (a) and (b)
  33.     above.

  35. You are specifically prohibited from charging, or requesting donations, for any
  36. copies, however made, and from distributing such copies with other products of
  37. any kind, commercial or otherwise, without prior written permission from CSI.
  38. CSI reserves the right to revoke the above distribution rights at any time, for
  39. any or no reason.

  41. This software, and all accompanying files, data and materials, are distributed
  42. "AS IS" and with no warranties of any kind, whether express or implied.  Good
  43. data processing procedure dictates that any program be thoroughly tested with
  44. non-critical data before relying on it.  The user must assume the entire risk of
  45. using the program.  This disclaimer of warranty constitutes an essential part of
  46. the agreement.  In no event shall CSI, or its principals, shareholders,
  47. officers, employees, affiliates, contractors, subsidiaries, or parent
  48. organizations, be liable for any incidental, consequential, or punitive damages
  49. whatsoever relating to the use of EasyImage Lite, or your relationship with CSI.

  51. In addition, in no event does CSI authorize you to use EasyImage Lite in
  52. applications or systems where EasyImage Lite's failure to perform can reasonably
  53. be expected to result in a significant physical injury, or in loss of life.  Any
  54. such use by you is entirely at your own risk, and you agree to hold CSI harmless
  55. from any claims or losses relating to such unauthorized use.

  57. This Agreement is the complete statement of the Agreement between the parties on
  58. the subject matter, and merges and supersedes all other or prior understandings,
  59. purchase orders, agreements and arrangements. This Agreement shall be governed
  60. by the laws of the State of  New York.  Exclusive jurisdiction and venue for all 
  61. matters relating to this Agreement shall be in courts and fora located in the
  62. State of New York, and you consent to such jurisdiction and venue.

  64. All rights of any kind in EasyImage Lite which are not expressly granted in this 
  65. License are entirely and exclusively reserved to and by CSI.  You may not rent, 
  66. lease, modify, translate, reverse engineer, decompile, disassemble or create 
  67. derivative works based on EasyImage Lite. You may not make access to EasyImage 
  68. Lite available to others in connection with a service bureau, application 
  69. service provider, or similar business, or use EasyImage Lite in a business to 
  70. provide image resizing services to others. There are no third party 
  71. beneficiaries of any promises, obligations or representations made by CSI 
  72. herein.
