  1. LICENSE AGREEMENT

  3. IMPORTANT-READ CAREFULLY BEFORE INSTALLING.

  5. By installing this SOFTWARE you indicate your agreement to 
  6. be bound by the terms of this Agreement. If you do not agree to 
  7. the terms of this Agreement, promptly delete this software from 
  8. your computer. This agreement continues in effect until you destroy
  9. all these materials and all copies made.

  11. Schurr Programs SOFTWARE LICENSE AGREEMENT.

  13. 1) GRANT OF LICENSE. This software is distributed as freeware. You 
  14. can copy and use the program at will provided no extra cost is charged
  15. for its distribution and usage except for the nominal cost of 
  16. distribution media etc. This program does not come with any sort of
  17. warranty; expressed or implied and you are using it at your own risk.

  19. 2) COPYRIGHT. Copyright and other laws concerning software and 
  20. intellectual property protect the SOFTWARE in part and not 
  21. exclusively. No right to create a derivative work is conveyed by 
  22. this license.

  24. 3) OTHER RESTRICTIONS. You acknowledge that you do not become the 
  25. owner of the SOFTWARE (software, programs and/or documentation). You
  26. agree not to rent, lease, sub-license, reverse engineer, modify, or
  27. translate, the SOFTWARE.

  29. LIMITED WARRANTY 
  30.  
  31. Limited Warranty. While we have attempted to ensure the reliability 
  32. of the product,  Schurr Programs, cannot assume any liability for 
  33. damage that occurs because of usage of this program, whether or not 
  34. in accordance with the instructions or specifications. It is not 
  35. possible to guarantee the program's performance under all circumstances,
  36. at all times, with all hardware and software configurations, and with
  37. any user data, programs, or series of commands.  You agree that 
  38. regardless of the form of any claim, Schurr Programs assumes no 
  39. liability for any damages or loss to you or anyone else. Use this 
  40. program at your own risk.

  42. NO OTHER WARRANTIES. There are no warranties expressed or implied, 
  43. including but not limited to, implied warranties of merchantability 
  44. or fitness for a particular purpose, and all such warranties are 
  45. expressly and specifically disclaimed.

  47. NO LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. In no event 
  48. shall Schurr Programs   or its suppliers, if any, be responsible for
  49. any special, incidental or consequential damages whatsoever 
  50. (including, without limitation, damages for lost profits, business
  51. interruption,loss of information, or any other loss) arising out 
  52. of the use or the inability to use this product, even if Schurr
  53. Programs has been advised of the possibility of such damage. Some 
  54. states do not allow the limitation or exclusion of liability for 
  55. incidental or consequential damages, so the above limitation or 
  56. exclusion may not apply to you. 
  57. This agreement shall be governed by the laws of the State of New York
  58. and shall inure to the benefit of Schurr Programs  and any successors,
  59. administrators, heirs and assigns. Any action or proceeding brought 
  60. by either party against the other arising out of or related to this 
  61. agreement shall be brought only in a STATE or FEDERAL COURT of 
  62. competent jurisdiction located in Niagara or Erie County, New York.
  63. The parties hereby consent to in personam jurisdiction of said courts.
  64. Governed by the laws of the state of New York.

  66. By installing this software you are agreeing to the terms of this
  67. Agreement.
