  1. Caligari Software License Agreement
  2. This is a legal agreement between you and Caligari, Corp. This
  3. agreement permits you to use one copy of the Caligari software
  4. product on any single computer, provided you use it on one computer
  5. at a time. The license only grants the right to use this software 
  6. and does not grant ownership in of the software or related materials 
  7. to anyone.. The software is owned by Caligari or its suppliers and 
  8. is protected by US copyright Laws and International Treaty 
  9. provisions. This license is your proof of license to exercise the 
  10. rights granted herein and must be retained by you.

  12. US Government Restricted Rights
  13. The Software and documentation are provided with Restricted Rights. 
  14. Use, duplication, or disclosure by the government is subject to 
  15. restrictions as set forth in subparagraph (c)(1)(ii) of the Rights 
  16. in Technical Data and Computer Software clause as DFARS 252.227-7013 
  17. or subparagraphs (c)(1), (2) and (3) of the Commercial Computer
  18. Software - Restricted Rights at 48 CFR 52.227-19 as applicable.

  23. License Agreement and included by reference.

  25. Limited Warranty
  26. Limited Warranty. Caligari warrants that the Software will perform 
  27. substantially in accordance with the accompanying written materials 
  28. and will be free from defects in materials and workmanship under 
  29. normal use and service for a period of ninety (90) days from the 
  30. date of receipt. Some states do not allow limitations on the 
  31. duration of an implied warranty, so the above limitations may not 
  32. apply to you. This limited warranty gives you specific legal rights.
  33. You may have others, which vary from state to state.
  34. Customer Remedies. CaligariÆs entire liability and your exclusive 
  35. remedy shall be, at CaligariÆs option, either (a) return of the 
  36. purchase price or (b) repair or replacement of the Software that 
  37. does not meet CaligariÆs Limited Warranty and that is returned to 
  38. Caligari with a copy of your receipt. This Limited Warranty is void 
  39. if failure of the Software has resulted from accident, abuse or 
  40. misapplication. Any replacement Software will be warranted for the 
  41. remainder of the original warranty period or thirty (30) days, 
  42. whichever is longer. Some of these remedies and product support 
  43. services offered by Caligari may not be available outside the 
  44. United States of America. 
  45. No Other Warranties. Caligari disclaims all other warranties, 
  46. either express or implied, including but not limited to implied 
  47. warranties of merchantability and fitness for a particular purpose, 
  48. with respect to the Software, the accompanying written materials and 
  49. any accompanying hardware. This limited warranty gives you specific 
  50. legal rights. You may have others, which vary from state to state.
  51. No liability for Consequential Damages. In no event shall Caligari 
  52. or its suppliers be liable for any damages whatsoever (including, 
  53. without limitation, damages for loss of business profits, business 
  54. interruption, loss of business information, or other pecuniary loss) 
  55. arising out of the use or inability to use this Caligari product, 
  56. even if Caligari has been advised of the possibility of such damages. 
  57. Because some states do not allow the exclusion or limitation of 
  58. liability for consequential or incidental damages, the above 
  59. limitation may not apply to you.
