  8. You should carefully read the following terms and conditions
  9. before using this software.  Unless you have a different license
  10. agreement signed by Gary Nugent, your use of this software indicates
  11. your acceptance of this license agreement and warranty.

  14. Registered Version

  16. One registered copy of LunarPhase may either be used by a single
  17. person who uses the software personally on one or more computers,
  18. or installed on a single workstation used nonsimultaneously by
  19. multiple people, but not both.
  20.  
  21. You may access the registered version of LunarPhase through a network,
  22. provided that you have obtained individual licenses for the
  23. software covering all workstations that will access the software
  24. through the network.  For instance, if 8 different workstations
  25. will access LunarPhase on the network, each workstation must have its
  26. own LunarPhase license, regardless of whether they use LunarPhase at
  27. different times or concurrently.

  30. Governing Law

  32. This agreement shall be governed by the laws of the European Union and
  33. the United States.

  36. Disclaimer of Warranty

  38. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND
  39. WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY
  40. OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.

  42. Because of the various hardware and software environments into
  43. which LunarPhase may be put, NO WARRANTY OF FITNESS FOR A PARTICULAR
  44. PURPOSE IS OFFERED.

  46. The user must assume the entire risk of using the program. ANY
  47. LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT
  48. REPLACEMENT OR REFUND OF PURCHASE PRICE.

  53. Evaluation and Registration

  55. LunarPhase is free to evaluate for 30 days or 100 uses (whichever is the 
  56. sooner), after which it should be registered. Corporate users must register 
  57. the software after an evaluation period of 30 days. Payments must be in 
  58. either Sterling (STGú15.00) or US Dollars (US$20).
  59. Those living within Ireland can register the software for IRú15.00.

  61. Payments should be forwarded to: Gary Nugent, 54a Landscape Park, Churchtown,
  62. Dublin 14, Ireland. Credit card ordering is not supported at the moment.

  64. Unregistered corporate use of LunarPhase following the 30-day evaluation
  65. period is in violation of international copyright laws.

  68. Distribution

  70. Provided that you verify that you are distributing the evaluation
  71. version, you are hereby licensed to make as many copies of the evaluation
  72. version of this software as you wish; give exact copies of
  73. the original evaluation EXE file version to anyone; and distribute the
  74. evaluation version of the software in its unmodified form via electronic
  75. means.  There is no charge for any of the above.

  77. You are specifically prohibited from charging, or requesting
  78. donations, for any such copies, however made; and from
  79. distributing the software with other products (commercial or otherwise)
  80. without prior written permission.
