  17. On Tuesday evening I called Rocky (Sysop of Citadel BBS) At 19:40 hrs. As
  18. soon as i called him my wife said "Theres 2 blokes walking up the path to
  19. the house, are you expecting anyone?" I Said "No,If theres a problem give
  20. me a shout". No sooner had i said it and started to chat to Rocky my wife
  21. said "You better get out here quick!". I dropped the telephone and ran to
  22. the hall..... I saw 3 suited men standing in my hall !!!.

  24. One of them said "I am detective Constable ??????? and I am arresting you
  25. for fraudulent use of electricity"
  26.  
  27. I told them to get out of my house before i throw you out.!!!  With that,
  28. one of the detectives got his badge out and flashed it in my face! I said
  29. "I dont care who you are,  show me a warrant or I'me throwing you through
  30. the door"(made of glass!!!) They radio'd for uniformed backup when i said
  31. that....I then said "before they get here, you're out of here,if you dont
  32. get out of here NOW, I'me throwing you out THROUGH the door!!!" With this
  33. they could tell that I was serious.....and they walked out the door.

  35. I walked out of the door straight after them, closing it on the way,  and
  36. said "ok then, lets go!". With that, i was arrested and taken in a car to
  37. a Police Station. I didnt say anything until my brief arrived and advised
  38. me what to say. In the meantime....I was banged up in a cell for 2 hours!

  40. When my brief arrived i spoke to her in a private booth,she asked me what
  41. i had done and told her the TRUTH. That i had been using 0800 numbers and
  42. obtaining free calls!.  She advised me to say that i was given the number
  43. from a friend of mine that worked for British Telecom, and that i was not
  44. told that I was committing a criminal act by using them!.I also said that
  45. I was not willing to give them his name as he was a friend,I would say no
  46. more than that because I didn't want him to lose his job!

  48. It was pointed out to me that what i was doing was committing "FRAUD".
  49.  
  50. FRAUD is an offence that you must inform all future employers of! This is
  51. a very serious offence.(though I was only using an 0800 number) FRAUD was
  52. still the crime!  I said that I was sorry for using it, but was not aware
  53. that I was breaking any laws!,  as a person who works for British Telecom
  54. gave me it!  I said that the number was given to me by him so i must have
  55. had permission!It was then pointed out that unless i was given permission
  56. by the person who pays the bill, I was not authorised.  I again said that
  57. I was sorry but i didn't know this.

  59. The British Telecom Investigation Manager then took over the questioning.
  60.  
  61. He introduced himself as Mr Adrian Gorham, British Telecom Investigation
  62. Manager. He went on to say that these numbers had been put on there only
  63. for British Telecom employees, who had been given permission to use them
  64. in carrying out they're duties! He said a lot of things........ 
  65.  
  66. 1. The numbers were put out on 6 Feb 95.
  67.  
  68. 2. The numbers were 0800 252 495 and 0800 526 192.
  69.  
  70. 3. Both of these numbers have been traced since they were put on!
  71.  
  72. 4. Anyone who has used this number, has had a trace put on their line!
  73.  
  74. 5. There are 5 arrests being made tonight, The night I was arrested!
  75.  
  76. 6. I was recieving calls every night for the previos 3 weeks that were
  77.    also using the numbers.

  79. 7. He told me EVERY 0800 number that i had dialled since 21 Nov 94!(six)
  80.  
  81. 8. He had a list of BBS's that i had called using these numbers.
  82.  
  83. 9. He said He knew that the majority of the calls to my number were used
  84.    with a modem!
  85.  
  86. I could go on a lot more than that, This bloke wasn't asking me anything
  87. he was telling me!!!  
  88.  
  89. He had every call i made since 21 Nov 94 in front of him(4 inches thick)

  99. This bloke had done his homework, and I dont think for a minute that him
  100. calling round my house was a rush job, this had been planned in advance!
  101. He also had my brothers number, He asked me if I recognised it?  He told
  102. me that my brother was using the number as well!He showed me a number of
  103. numbers and told me that they were also using the number! I said that as
  104. soon as I got home I would be calling these people and telling them that
  105. you are monitoring there numbers and they wont use 0800 numbers again!

  107. He told me that if they used them they would be getting a visit! I think
  108. he was serios, he had no reason not to be! He then asked what I intended
  109. to do about all the calls that I had made through the 0800 numbers?
  110.  
  111. I told him that because an employee of British Telecom gave them to me I
  112. thought that I could use the numbers and not pay!If I had known that all
  113. the calls were going to be charged I wouldnt have used the phone so much
  114. and that I was not prepared to pay for the calls that I had made!
  115.  
  116. The interview then finished.   I was then released on unconditional bail
  117. until 3 May 95. I have to return to the Police Station then. In the mean
  118. time,this gives the Police and British Telecom 6 weeks to put their case
  119. together. 
  120.  
  121. I am facing the following charges.....
  122.  
  123.      1. Having FRAUD against my name for life.
  124.      2. A fine imposed by the courts for FRAUDULENT USE OF ELECTRICITY.
  125.      3. British Telecom Demanding their money back (through the court).
  126.         For all the calls that I have made through the 0800 numbers.

  128. What was a bit of fun has turned a lot WORSE!!!!

  130. At the end of the day, I did not have my equipment taken! only due to my
  131. forcefulness when they came into my house!I know that there are a lot of
  132. you out there still living with your parents! this could be embarressing
  133. for them (neighbours) as it would be for you.  (We all know what parents
  134. are like......yes officer, come in, yes my lad does have a computer, yes
  135. officer he's on it now in the bedroom........) I think you know what I'm
  136. saying. You havn't a leg to stand on, at least I did!

  138. To finish,
  139.          I can honestly say that I will not be using another 0800 number
  140. for the rest of my life, I cannot afford to be seen to KNOWINGLY use one
  141. of these numbers again after being done for it previously.

  143. To all of you out there who are worrying about the numbers you have used
  144. i can only advise you of this.....
  145.  
  146. If you havnt been caught yet,stop using it.!In 6 months you can use them 
  147. again for a little while..BUT,if you get caught this time round you will
  148. not be able to do it again the same as me!!

  150. I have been told by the British Telecom Investigation Manager that those
  151. 0800 numbers are being monitored at this moment!,  they are not going to
  152. pull the plug on them, as long as people are using them and they can get
  153. more arrests they will!!!!

  155. There are 6 numbers that they are monitoring, at least, because they are
  156. the ones I have been using!!!!!

  158. At the end of the day you are the only one who has to decide what to do!

  160. But, my advice is.... STAY OFF THEM .... COME BACK ANOTHER DAY!!
