  10.   Eagle Performance Software is glad that you had the opportunity to test this 
  11.   high quality software!  If you have decided to use the routines or the 
  12.   documentation for your benefit, you are expected to register.  It will 
  13.   assure you that you have up to date products and access to customer service.

  16.   LEVELS OF REGISTRATION

  18.   Two Levels - If you want to register, you can choose one of two levels of 
  19.   registration - (1) non-profit user or (2) commercial user.  All registrants 
  20.   will receive the complete source code (except for SYS unit).

  22.   NON-PROFIT USER - For a private license, registration may be for private or 
  23.   non-profit Shareware use.  As a restriction, you may NOT produce executable 
  24.   code programs for profit.

  26.   COMMERCIAL USER - For this level, a corporation, company, institution, 
  27.   organization, or individual can use the software to create executable 
  28.   programs to DIRECTLY or INDIRECTLY make a profit.  The source code cannot be 
  29.   sold or distributed.  No royalties are required.

  32.   FEES

  34.   License Agreement Form - The License Agreement, LICENSE.LIC, has the fees
  35.   for each level of registration including upgrading from previous 
  36.   versions.

  38.   Mailing in License - The License Agreement, LICENSE.LIC, must be signed 
  39.   and mailed to the author(s) for registration.  Purchasing the product 
  40.   constitutes agreement with this license.

  42.   Distribution - The distribution of the publically released software is 
  43.   encouraged and can only be distributed without profit.  ASP approved vendors 
  44.   may distribute the software if the price does not exceed $5.  Permission is 
  45.   required otherwise.

  47.   Texas Orders - Only orders in Texas need to add the Texas sales tax.

  49.   Foreign Orders - For checks not drawn on U.S. banks, add $5 to the total.  
  50.   Add $3 for shipping.  Only U.S. dollars accepted.

  52.   Accounting - If you are in a profit making organization, you can usually get 
  53.   the funds from petty cash accounts rather than going through major 
  54.   approvals.

  57.   BASIC TERMS:

  59.   1. This license applies to the Turbo Pascal, C, and/or Assembly source code 
  60.      for each product.
  61.  
  62.   2. You must treat the software just like a book - ONLY ONE CPU PER LICENSE 
  63.      can use the software at the same time in the original or modified forms.  
  64.      However, you are authorized to make archival copies for safekeeping.
  65.  
  66.   3. You may not modify the code and redistribute it to other users without 
  67.      permission of the author.

  69.   4. The license applies to the original copy of the code as well as updated 
  70.      versions which are available on CompuServe's Borland Forum.  The author 
  71.      is neither obligated to provide updated versions nor notices of error 
  72.      corrections.

  74.   5. Customer support will be provided as outlined in the introduction of the 
  75.      software documents.

  77.   6. The user agrees to conscientiously respect the copyright to the author of 
  78.      the code and not to illegally, unethically, or neglectfully exploit the 
  79.      services provided by the author(s).

  81.   7. NO COMPETITION - In no case shall any user use any portion of the code or 
  82.      documentation to commercially compete with Eagle Performance Software.

  84.   8. This code is provided "as is" without warranty of any kind, either 
  85.      expressed or implied, included but not limited to the implied warranty of 
  86.      merchantability and fitness for a specific purpose.  The entire risk as 
  87.      to the quality and performance of the coding is with you.  Should the 
  88.      code prove defective, you assume the entire cost of all necessary 
  89.      servicing, repair or correction.

  91.   9. In no event will the author be liable to you for any damages, including 
  92.      any lost profits, lost savings or other incidental or consequential 
  93.      damages arising out of the use or inability to use this code.
