  1. SAN JOSE, CA-MARCH 26, 1992--Accolade announced today that the American
  2. Committee for Interoperable Systems (ACIS) has filed an amicus brief
  3. supporting the legality of the reverse-engineering process at issue in
  4. Accolade's litigation with Sega. The litigation commenced when Sega filed
  5. a complaint in federal district court in San Francisco alleging that
  6. Accolade had infringed Sega's trademark. Sega subsequently amended its
  7. complaint to allege that Accolade's development practices constituted
  8. copyright infringement. Accolade, which develops and markets games
  9. compatible with the Sega (Genesis) console without an official license
  10. from Sega, then counter-sued, claiming restraint of trade and unfair
  11. business practices. The ACIS brief addresses the legal issues involved in
  12. Sega's copyright claims against Accolade.

  14. ACIS is an organization of companies in the computer industry that
  15. includes: Amdahl, Bull HN Information Systems, Chips and Technologies,
  16. Clearpoint Research, Comdisco, Emulex, Forecross, Informix Software,
  17. Johnson-Laird, Kapor Enterprises, Landmark Systems, NCR, Phoenix
  18. Technologies, Seagate Technology, Software Association of Oregon, Storage
  19. Technology, Sun Microsystems, Systems Center, 3Com, Unisys, and Zenith
  20. Data Systems.

  26. concerned that an improper extension of the scope of protection under
  27. copyright law will impede innovation and inhibit fair competition in the
  28. computer industry."

  31. compete fairly will ultimately prevail in the entertainment software,
  32. video game and other computer-related industries," continued Miller.

  39. marketer, of video games for the Sega Genesis system.
