  2.    CONDITIONS FOR RELEASE, USE AND DISTRIBUTION
  3.    --------------------------------------------

  5.    Non-commercial uses:
  6.  
  7.    TPBoard (hereafter to include TPBoard and all associated
  8.    files and utilities) is distributed as shareware.  This means
  9.    that you can use TPBoard as is without paying a registration
  10.    fee.  If you do not pay a registration fee, TPBoard will
  11.    continue to operate.  Each and every time you execute 
  12.    TPBoard, however, you will see a message that informs the 
  13.    caller that your copy of TPBoard is not a registered copy.  
  14.    This is the only difference between registered and non-
  15.    registered copies of standard TPBoard.

  17.    Registration:

  19.    Registration consists of mailing a registration form along
  20.    with the appropriate registration fee(s) to the address
  21.    provided on the registration form below.  Upon receipt of the 
  22.    form and fee(s), you will receive a file called TPBoard.KEY.  
  23.    This "key" makes your version registered and TPBoard will
  24.    thereafter show callers that your copy of TPBoard is a
  25.    registered copy.  All keys will also be used by subsequent
  26.    updates of TPBoard.

  28.    Registration is split into two levels according to the amount
  29.    of the registration.  Level 1 registration is $75.00 (single
  30.    user) and provides registration for TPBoard as distributed with 
  31.    support utilities, documentation on disk, and user support via 
  32.    telephone.

  34.    Level 2 registration is $175.00 (single user and network
  35.    version) and provides registration for TPBoard as distributed
  36.    with support utilities, and user support via telephone.  In 
  37.    addition, the key you receive for Level 2 registration provides 
  38.    the following features of TPBoard, thus called TPBoard+:

  40.      1) dBaseIII Database functions.
  41.      2) Message base compression/decompression for up to 35%
  42.         savings in disk space.
  43.      3) Extended file descriptions of any length.
  44.      4) Network support for up to 99 nodes
  45.      5) The NED/SED editors.
  46.      6) Private file transfers between callers
  47.  
  48.    Commercial use of TPBoard
  49.    -------------------------
  50.  
  51.    TPBoard may ONLY be used in a commcerical setting when fully
  52.    and properly registered at Level 2.  "Commercial" in this
  53.    context to mean:
  54.  
  55.       - ANY commcercial/profit establishment
  56.       - ANY nonprofit or not-for-profit organization
  57.       - ANY public (government) agency
  58.       - ANY use other than "at-home" for "fun" operations
  59.       - ANY board that REQUIRES fees for board privileges
  60.  
  61.    Any unregistered use by a commcercial entity violates the
  62.    terms of the distribution agreement and voids ANY license to
  63.    use TPBoard.
  64.  
  65.    Liability:
  66.  
  67.    The author(s) shall not be liable for any damage whether
  68.    direct, indirect, special or consequential arising from
  69.    failure of any or all of the enclosed programs to operate in
  70.    the manner desired by the user(s).  The authors shall also
  71.    not be liable for any damage to data or property that may be
  72.    caused directly or indirectly by the use of these programs.

  74.    In no event will the authors be liable to the user(s)  for
  75.    any damages, including any lost profits, lost savings or
  76.    other consequential  or  incidental damages arising out of
  77.    the use or inability to use the programs, or FOR ANY CLAIM BY
  78.    ANY OTHER PARTY.  By using any or all of the enclosed
  79.    programs,  you acknowledge that you have read every part of
  80.    this document and have agreed with each and all provisions of
  81.    the present disclaimer.

  84.    Sending in your registration
  85.    ----------------------------

  87.    TPBoard registrations can be mailed to one of two addresses.
  88.  
  89.    Note, however, that charge card registrations sent to the 
  90.    author will take a few days longer to process for payment.
  91.    SEND ALL registrations for Level 1 to Plain Jayne Software
  92.    using the first form;  registrations for Level 2 can be sent
  93.    to either address using either form.
  94.  
  95.    Also note that ALL payments must arrive in FULL U.S. funds;
  96.    do not send a foreign funds unless the conversion to U.S.
  97.    funds will be for the proper amount.
  98.  
  99.    Shipping and handling charges for orders without documentation 
  100.    can be avoided *IF* you provide a Fidonet address to which we
  101.    can send your registration key.  Otherwise, a diskette must
  102.    be mailed.
