  1. Limited Use Software License Agreement

  3. This Limited Use Software License Agreement (the "Agreement") is a legal agreement
  4. between you, the end-user and Elpin Systems.  By continuing the installation of this 
  5. game program, by loading or running the game, or by placing or copying the game 
  6. program onto your computer hard drive, you are agreeing to be bound by the terms of 
  7. this Agreement.

  10. Elpin Systems. Software License
  11.  
  12. 1. Grant of License. Elpin Systems grants to you the right to use the game program 
  13. Super Ice Qube Hopper which is the shareware version of our title Super 
  14. Ice Qube Hopper. For purposes of this section, "use" means loading the Software 
  15. into RAM, as well as installation on a hard disk or other storage device.  You may not:
  16. modify, translate, disassemble, decompile, reverse engineer, or create derivative works
  17. based upon the Software.

  19. 2.  Copyright.  The software is owned by Elpin Systems. and is protected by United 
  20. States copyright laws and international treaty provisions.  You must treat the Software 
  21. like any other copyrighted material, except that you make copies of the Software to 
  22. give to other persons.

  24. 3.  Limited Warranty.  ELPIN SYSTEMS DISCLAIMS ALL WARRANTIES,  EITHER 
  25. EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED 
  26. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR  
  27. PURPOSE, AND ALL SUCH WARRANTIES ARE EXPRESSLY AND SPECIFICALLY 
  28. DISCLAIMED.  NEITHER ELPIN SYSTEMS NOR ANYONE ELSE WHO HAS BEEN 
  29. INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THIS SOFTWARE 
  30. SHALL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL  
  31. DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH SOFTWARE  
  32. EVEN IF ELPIN SYSTEMS HAS BEEN ADVISED OF POSSIBILITY OF SUCH 
  33. DAMAGES OR CLAIMS.  IN NO EVENT SHALL ELPIN SYSTEMS LIABILITY FOR 
  34. ANY DAMAGES EVER EXCEED THE PRICE PAID FOR LICENSE TO  USE THE 
  35. SOFTWARE, REGARDLESS OF THE FORM OF QUALITY AND PERFORMANCE  
  36. OF THE SOFTWARE.

  39. Some states do not allow the exclusion of the limit of liability for consequential or 
  40. incidental damages, so the above limitation may not apply to you.  This agreement shall 
  41. be governed by the laws of the State of California and shall insure to the benefit of ELPIN 
  42. SYSTEMS and successors, administrators, heirs and assigns.  Any action or 
  43. proceeding brought by either party against the other arising out of or related to this 
  44. agreement shall be brought only in a STATE or FEDERAL COURT of competent 
  45. jurisdiction located in Santa Clara County, Calif.  The parties hereby consent to in 
  46. personae jurisdiction of said courts.
