  2. By opening this package, or reproducing, installing, or using the enclosed
  3. materials, you are agreeing to be bound by the terms of this agreement. If

  8. LICENSE:  Subject to the Restrictions below, ProPro Group, Inc. ("ProPro")
  9. grants to you the following non-exclusive, non-assignable, royalty-free
  10. copyright licenses in the "Materials" below, which are identified specifically
  11. in the enclosed documentation:

  13. SAMPLE DATA may include examples of 3D models, raster images and fonts in both
  14. binary and ASCII text form. You may copy and modify the Sample Data and
  15. distribute it in unmodified form.
  16.  
  17. END-USER DOCUMENTATION includes textual materials intended for end users.
  18. You may copy, modify and distribute them.
  19.  
  20. LICENSED BINARIES are redistributable code provided in binary form.
  21. You may copy and distribute Licensed Binaries with your product in
  22. unmodified form.

  24. RESTRICTIONS:  The Materials are in preliminary public-domain release form
  25. and may not be fully functional.  You will be able to continue distribution
  26. of them upon ProPro's release of a production version, if any, however you
  27. agree to make reasonable efforts to distribute updates or upgrades incorporating
  28. such production version of the Materials to customers who have received this
  29. preliminary version. You may not reverse-assemble, reverse-compile, or otherwise
  30. reverse-engineer any software provided solely in binary form.

  32. Distribution of the Materials is also subject to the following limitations
  33. you (i) shall be solely responsible to your customers for any update or support
  34. obligation or other liability which may arise from the distribution, (ii) do not
  35. make any statement that your product is "certified," or that its performance is
  36. guaranteed, by ProPro, (iii) do not use ProPro's name or trademarks to market
  37. your product without written permission, (iv) shall prohibit disassembly and
  38. reverse engineering, and (v) shall indemnify, hold harmless, and defend ProPro
  39. and its authorised suppliers or distributors from and against any claims or lawsuits,
  40. including attorney's fees, that arise or resultfrom your distribution of any
  41. product.

  43. COPYRIGHT:  Title to the Materials and all copies thereof remain with ProPro or
  44. its authorised suppliers and distributors. The Materials are copyrighted and are
  45. protected by Russia copyright laws and international treaty provisions. You may
  46. not remove any copyright notice from the Materials.  You agree to prevent any
  47. unauthorized copying of the Materials. Except as expressly provided herein,
  48. ProPro does not grant any express or implied right to you under ProPro patents,
  49. copyrights, trademarks, or trade secret information.

  51. LIMITATION OF LIABILITY: PROPRO OFFERS NO WARRANTY OF ANY KIND EITHER EXPRESSED
  52. OR IMPLIED INCLUDING THOSE OF MERCHANTABILITY, NONINFRINGEMENT OF THIRD-PARTY
  53. PROPROLECTUAL PROPERTY, OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER PROPRO NOR
  54. ITS AUTHORISED  SUPPLIERS AND  DISTRIBUTORS  SHALL BE LIABLE FOR ANY DAMAGES
  55. WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS,
  56. BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS) ARISING OUT
  57. OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF PROPRO OR ITS AUTHORISED
  58. SUPPLIERS AND DISTRIBUTORS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  59. BECAUSE SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR
  60. CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

  62. TERMINATION OF THIS LICENSE: ProPro may terminate this license at any time if
  63. you are in breach of any of its terms and conditions. Upon termination, you
  64. will immediately destroy the Materials or return all copies of the Materials
  65. to ProPro along with any copies you have made.

  67. GOVERNMENT RESTRICTED RIGHTS: The Materials are provided with "RESTRICTED
  68. RIGHTS." Use, duplication or disclosure by the Government of any country
  69. including Russia but not limited to is subject to restrictions. Use of the
  70. Materials by the Government constitutes acknowledgment of ProPro's rights
  71. in them.

  73. APPLICABLE LAWS: This Agreement is governed by the laws of the Russian
  74. Federation. You may not export the Materials in violation of applicable
  75. export laws.
