  1. COMPUSERVE INFORMATION SERVICE OPERATING RULES

  3. The CompuServe Information Service (the "Service") consists of
  4. computing and information services and software, information and
  5. other content provided by CompuServe Incorporated ("CompuServe"). 
  6. In addition, third parties provide information, software, and
  7. other content (collectively, "Third Party Content") which may be
  8. accessed over the Service.  These Operating Rules are provided to
  9. make online information usage and communications a positive and
  10. secure experience for members.

  12. Members agree during the online sign up procedure to the terms
  13. and conditions outlined in the Operating Rules.

  15. INTRODUCTION

  17. These Operating Rules are part of the terms of your Service
  18. Agreement with CompuServe, and you are bound by them.  CompuServe
  19. may modify these rules at any time by publishing the modified
  20. rule(s) over the Service. 
  21.  
  22. COMPUSERVE COPYRIGHT 
  23.  
  24. The entire contents of the Service, are copyrighted as a
  25. collective work under the United States Copyright laws.  The
  26. copying, redistribution, or publication of any part of the
  27. Service is prohibited, except as expressly provided below.

  29. Each member who places information, software or other content, in
  30. the public areas of the Service grants CompuServe the right to
  31. edit, copy, publish, distribute, and translate such information,
  32. software or other content.  Subject to this grant, each member who
  33. places information, software or other content on the Service
  34. retains any rights member may have in such information, software
  35. or other content.

  37. COPYRIGHTED MATERIAL

  39. Copyrighted material must not be placed on the Service without
  40. the permission of the owner(s) or person(s) they specifically
  41. authorize.  Only the owner(s) or such authorized person(s) may
  42. upload copyrighted material to the Service.

  44. Members may download copyrighted material for their own use.
  45. Except as expressly provided by copyright law, copying,
  46. redistribution, or publication must be with the express
  47. permission of CompuServe and the owner(s) or such authorized
  48. person(s), if other than CompuServe.  Permission must be
  49. specified in the document, on the Service, or must be obtained
  50. directly from CompuServe and the owner(s) or such authorized
  51. persons(s), if other than CompuServe.  In any copying,
  52. redistribution, or publication of copyrighted material, any
  53. changes to or deletion of author attribution or copyright notice
  54. are prohibited.

  56. PUBLIC DOMAIN MATERIAL

  58. Any member may upload public domain programs to the Service. Any
  59. member may download public domain programs for their own use or
  60. non-commercially redistribute a public domain program.  Member
  61. assumes all risks regarding the determination of whether a
  62. program is in the public domain.

  64. CONTENT & USES OF THE SERVICE

  66. Member agrees not to publish on or over the Service any
  67. information, software or other content which violates or
  68. infringes upon the rights of any others or which would be
  69. abusive, profane or sexually offensive to an average person, or
  70. which, without the approval of CompuServe, contains any
  71. advertising or any solicitation of other members to use goods or
  72. services.  This paragraph, however, shall not be interpreted to
  73. restrict member from utilizing CompuServe Mail in the conduct of
  74. a legitimate business except that member may not, without the
  75. approval of CompuServe, send unsolicited advertising or
  76. promotional material to other CompuServe members.

  78. Member agrees not to use the facilities and capabilities of the
  79. Service to conduct any business or activity or solicit the
  80. performance of any activity which is prohibited by law or to
  81. solicit members to become members of other competitive information
  82. services.

  84. EDITING AND DELETING CONTENT

  86. CompuServe reserves the right in its sole discretion to edit or
  87. delete any information, software or other content appearing on
  88. the Service, regardless of whether it violates the standards for
  89. content.

  91. SERVICE TERMINATION

  93. CompuServe reserves the right in its sole discretion to suspend
  94. or terminate Service to any member at any time. 
  95.  
  96. INDEMNIFICATION

  98. Member agrees to indemnify and hold CompuServe harmless from any
  99. claims and expenses, including reasonable attorney's fees,
  100. related to member's violation of the Service Agreement, including
  101. these rules or any information, software or other content placed
  102. on the Service by the member.  
  103.  
  104. STANDARD PRICING PLAN 
  105.  
  106. Multiple members of the same household may share a single User ID
  107. Number. However, only one person is authorized to access the
  108. Service at any given time on one User ID Number.
