  1. PLEASE READ THE FOLLOWING AND ENTER "YES" IF YOU AGREE WITH THE TERMS
  2. AND CONDITIONS.

  4. 1.   LICENSE:  Viacom New Media ("VNM") grants to you a nontransferable
  5. right to use the copy of the software program, Congo the Movie - Descent
  6. into Zinj (the "Software").  You may not copy the Software or any
  7. accompanying materials (the "Documentation"), except that you may make
  8. one copy for backup purposes.  You may not place the Software on a
  9. computer that would allow multiple users to access it.  You may not
  10. reverse engineer, disassemble, decompile, modify, adapt, translate, or
  11. create derivative works of the Software or Documentation.  VNM retains
  12. all rights, title, and ownership in the Software.  VNM may terminate this
  13. license immediately if you fail to comply with its terms.

  15. 2.   WARRANTY:  VNM warrants that the Software will perform substantially
  16. in accordance with the Documentation for a period of ninety (90) days
  17. from the date of purchase.  VNM's entire liability and your sole and
  18. exclusive remedy is the return of the Software for a refund of the
  19. amounts paid by you or a replacement copy of the Software, so long as the
  20. Software is returned to VNM in the original packaging with a copy of your
  21. receipt and has not been subject to misuse, neglect, improper
  22. installation, repair, alteration, or damage by you.  Any replacement
  23. Software will be warranted for the remainder of the original warranty
  24. period.  EXCEPT FOR THE EXPRESS WARRANTIES ABOVE, VNM DISCLAIMS ALL OTHER
  25. WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THE IMPLIED
  26. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR  A PARTICULAR PURPOSE AND
  27. NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

  29. 3.   LIMITATION OF LIABILITY:  IN NO EVENT WILL VNM OR ITS SUPPLIERS BE
  30. LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES
  31. ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, EVEN IF VNM HAS BEEN
  32. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  IN NO EVENT SHALL LIABILITY
  33. OF VNM FOR DAMAGES HEREUNDER EXCEED THE AMOUNT PAID BY YOU FOR THE
  34. SOFTWARE.
  35.  
  36. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF IMPLIED WARRANTIES OF
  37. LIABILITY FOR INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, SO
  38. THE ABOVE LIMITATIONS MAY NOT ALWAYS APPLY.

  40. BY ENTERING "YES" BELOW, YOU ACKNOWLEDGE THAT YOU HAVE READ AND
  41. UNDERSTAND THIS AGREEMENT, AND AGREE TO BE BOUND BY ITS TERMS.  YOU ALSO
  42. AGREE THAT THIS AGREEMENT IS THE ONLY AGREEMENT BETWEEN YOU AND VNM AND
  43. SUPERSEDES ALL OTHER COMMUNICATIONS BETWEEN YOU AND VNM RELATING TO
  44. THE SOFTWARE.
