  25. Plain English Shareware Licence Agreement and Limited Warranty
  26.  
  27. (1)  Introduction.  This agreement explains when and how you may use
  28. both Shareware and Registered Copies of software products from
  29. Crystal Software. In this agreement:
  30.  
  31.      *    "Program" means the software product you have purchased or
  32.           obtained for evaluation, including the software,
  33.           associated documentation and other materials;
  34.           
  35.      *    "Shareware Copy" means a copy of the Program distributed
  36.           by us or by our authorised agents for evaluation purposes
  37.           and which is described as an unregistered evaluation copy
  38.           by the Program's "About" screen;
  39.           
  40.      *    "Registered Copy" means a copy of the Program purchased
  41.           from us or from a dealer, and which is described as an
  42.           registered copy by the Program's "About" screen;
  43.           
  44.      *    "we", "us", "our" refers to Crystal Software, a business
  45.           based in Victoria, AUSTRALIA; and
  46.           
  47.      *    "you" means the end user of the Program.
  48.           
  49.  
  50. (2)  Legal Agreement.  This is a legal agreement which allows you,
  51. the end user, to use the Program under certain terms and conditions.
  52. If you cannot agree to abide by what this agreement says you should
  53. not use or evaluate the Program. By using the Program you agree to
  54. abide by the terms and conditions stated herein.
  55.  
  56. (3)  Copyright.  The Program is fully protected by copyright under
  57. federal law and international treaty provisions.
  58.  
  59. (4)  Evaluation Period.  You may use a Shareware Copy of the Program
  60. for an evaluation period of up to 30 days, in order to determine
  61. whether the Program meets your needs before purchasing it. Once the
  62. evaluation period ends, you agree to either purchase a Registered
  63. Copy of the Program, or to stop using it. If you have ordered a
  64. Registered Copy of the Program from us or from a dealer, you may
  65. continue to use your Shareware Copy until your Registered Copy
  66. arrives.

  68. (5)  Use of the Program.  While you are evaluating the Program, you
  69. may use it on as many computers as are required to perform your
  70. evaluation. Your 30-day evaluation period begins when you first
  71. install the Program on one or more computers for evaluation purposes.
  72. Once the evaluation period is over and you purchase the Program, your
  73. use is subject to the following restrictions:

  75.      (A)  You agree not to install or use any single user copy of
  76.           the Program on more than one computer at a time. However,
  77.           you may install an individual copy simultaneously on one
  78.           computer at work, one computer at home, and one portable
  79.           computer, if all these computers are used primarily by the
  80.           same individual, and there is no possibility that the
  81.           computers will be in use at the same time except while you
  82.           are actively transferring files between them. (If the
  83.           Program was purchased by your employer you agree to get
  84.           your employer's explicit permission before installing the
  85.           Program on multiple computers as described above.)
  86.           
  87.      (B)  If you purchased a server licence for the Program you
  88.           agree not to install or use it on more than one network
  89.           file server. The Program is identified as a server version
  90.           by the Program's "About" screen.
  91.           
  92.      (C)  If you purchased a site licence for the Program you may
  93.           install it on every computer at just one postal address,
  94.           usually one building. The Program is identified as a site
  95.           version by the Program's "About" screen.
  96.           
  97.      (D)  If you purchased a company licence for the Program you may
  98.           install it on every computer that your company uses. The
  99.           Program is identified as a company version by the
  100.           Program's "About" screen.

  103. (6)  Making and Distributing Shareware Copies of the Program.
  104.  
  105. You may make copies of your Shareware Copy of the Program to give to
  106. others, as long as you include all of the files that you originally
  107. received with your Shareware Copy. When you give a Shareware Copy of
  108. the Program to another person, you agree to inform them that their
  109. copy is to be used for a time-limited evaluation period, and that
  110. they must purchase a Registered Copy if they continue to use the
  111. Program once the evaluation period has ended. You agree not to sell
  112. Shareware Copies of the Program or distribute them to others for any
  113. kind of compensation or fee unless the fee solely covers your costs
  114. in providing it to the end user.

  116. (7)  Copying Registered Copies of the Program.  When you receive a
  117. Registered Copy of the Program you may make copies of the Program
  118. software which are necessary for normal backup purposes. You agree
  119. not to make any other copies of the software, the documentation or
  120. other materials, or any part of them, or sell, give, or make
  121. available any copies to others, without our advance written
  122. permission.

  124. (8)  Modification of the Program.  You may not reverse-engineer,
  125. disassemble or modify the Program in any way.
  126.  
  127. (9)  Operation of the Program.  The Program offers powerful
  128. capabilities. If you do not follow our instructions, or if you use
  129. the Program improperly, you can destroy files or cause other damage
  130. to your software and data. You assume full responsibility for the
  131. selection and use of the Program to achieve your intended results.
  132.  
  133. (10)  LIMITED WARRANTY:  The following limited warranty applies to
  134. Registered Copies of the Program. It is included here so you
  135. understand what your warranty will be when you purchase a Registered
  136. Copy. This warranty does NOT apply to Shareware Copies of the
  137. Program.
  138.  
  139. Physical Defects.  We pledge that any disks and manuals we send you
  140. will arrive free of physical defects which interfere with normal use.
  141. If you find such a defect and report it to us within 30 days after
  142. you purchase the Program, we agree to replace the defective item(s)
  143. at no charge to you as long as the defect was not caused by misuse or
  144. abuse.
  145.  
  146. Bugs and Program Errors.  We don't promise that the Program will be
  147. free of bugs or program errors. If you report a program error or bug
  148. to us, we will use our best efforts to correct it. If we issue a
  149. release of the Program which includes a correction for an error you
  150. reported, we will send you a copy of that release at no charge
  151. (except for materials, postage and packing costs) if you request it.
  152.  
  153. (11) DISCLAIMERS AND LIMITATIONS.  And now the legal language we
  154. couldn't avoid:

  156. DISCLAIMER FOR SHAREWARE COPIES:  YOU ARE NOT PAYING FOR THE TRIAL
  157. USE LICENCE FOR YOUR SHAREWARE COPY OF THE PROGRAM. ACCORDINGLY THE
  158. SHAREWARE COPY IS PROVIDED "AS-IS" AND WITHOUT WARRANTY OF ANY KIND.

  160. DISCLAIMER FOR REGISTERED COPIES: Except for the limited warranty
  161. stated above, we disclaim any and all other warranties, express or
  162. implied, oral or written, including any implied warranties of
  163. merchantability or fitness for a particular purpose. The limited
  164. warranty above gives you specific legal rights, but you may have
  165. other rights, depending on where you purchased the Program.
  166.  
  167. LIMITATION OF LIABILITY.  IN NO EVENT SHALL WE BE LIABLE FOR ANY
  168. INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER ARISING OUT
  169. OF USE OF THE PROGRAM OR YOUR RELATIONSHIP WITH US. SOME COUNTRIES OR
  170. STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF LIABILITY FOR
  171. INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE THE ABOVE LIMITATION
  172. MAY NOT APPLY TO YOU.

  174. (12) This agreement is to be interpreted under the laws of the state
  175. of Victoria, Australia.
