  9. This document describes the terms and conditions by which Magorum
  10. Praeda Interactive, Inc. will license other parties to use and
  11. distribute this software program. This software program
  12. (the "Program") is intended solely for distribution as "shareware"
  13. (i.e. "try before you buy"). The Program IS NOT public domain, nor
  14. free software, nor "freeware". No use, copying, reproduction or
  15. distribution of the Program, or copies of the Program, is authorized
  16. except in compliance with the terms and conditions set forth in this
  17. document.

  19. The Program is protected by copyright laws in Canada and in the United
  20. States, and in other countries pursuant to international treaties.
  21. Magorum Praeda Interactive, Inc. is the exclusive worldwide licensor
  22. of the Program, and the copyrights and other proprietary rights therein.

  24. The attached VENDINFO data record is hereby incorporated by reference.
  25. Any distribution satisfying all the distribution requirements expressed
  26. in that data record is hereby authorized.

  28. Limited Use And Distribution License

  31. 1.
  32.   You may use this Program without registering for a period of thirty
  33.   (30) days. After this period, you have to properly register the
  34.   Program to continue using it.
  35.  
  36. 2.
  37.   You may not decompile, recompile, disassemble, reverse engineer,
  38.   adapt, make modifications of any sort or create derivative works
  39.   of the Program or any files or elements thereof, unless with written
  40.   permission from Magorum Praeda Interactive, Inc.

  42. 3.
  43.   You may not rent, lease, sell or license the Program to anyone, nor
  44.   offer the Program on a pay-per-play basis, unless with written
  45.   permission from Magorum Praeda Interactive, Inc.

  47. 4.
  48.   In all distribution of the Program, which include, without limitation,
  49.   BBS downloads, packaging, advertising, documentation, magazines,
  50.   catalogs, FTP downloads, bundling with hardware, distribution CDs,
  51.   magazine cover CDs and Web site downloads, Magorum Praeda Interactive,
  52.   Inc. shall be credited as the owner of the Program. Furthermore, the
  53.   Program must be identified as shareware (and not identified as "free
  54.   software", nor as "public domain", nor the like). In all
  55.   distribution, Magorum Praeda Interactive, Inc. would appreciate that
  56.   you let us know that you are distributing our Program.

  59.   In all distribution, the shareware concept shall be explained in enough
  60.   detail. Shareware is "try before you buy" and the price paid by the
  61.   user to obtain the Program from a distributor is a distribution charge
  62.   only.

  65.   The Program must be distributed in its original, unaltered form. All
  66.   files within the package (install file) must stay together and
  67.   unmodified.
  68.   Furthermore, the files in the package must not be renamed. The files of
  69.   the Program and all the elements of the Program must be distributed as
  70.   a complete package. You may not change, rename, merge, delete any files
  71.   of the package or add any files to the package.
  72.   You may not remove or alter any copyright information on the Program,
  73.   and you must take reasonable steps to protect the copyrights and other
  74.   rights of Magorum Praeda Interactive, Inc. on the Program.

  77.   The Program is intended for distribution as shareware only. You shall
  78.   not charge any fee for the Program, although you may charge a
  79.   distribution fee for costs associated with the distribution of the
  80.   Program. You are encouraged and permitted to distribute copies of the
  81.   Program as long as you follow the terms and conditions in this
  82.   license agreement.

  85.   Magorum Praeda Interactive, Inc. has the rights to update the Program,
  86.   it's contents and all it's associated files and elements at its
  87.   discretion, without any obligation or consent from any licensed users
  88.   or distributors.

  91.   As for this license, your right to distribute the Program is
  92.   nonexclusive.
  93.   Magorum Praeda Interactive, Inc. can terminate the license granted to
  94.   you hereunder at any time and for any reason upon written notice.

  96. 10.
  97.   The registration code that the user receive from registration is the
  98.   property of the user that registers and Magorum Praeda Interactive
  99.   Inc.. The registration code may not be given to any other user, or
  100.   distributed in any way. The user and distributor must take reasonable
  101.   steps to protect the copyrights, trademarks and other rights of
  102.   Magorum Praeda Interactive Inc. for this product.

  105.   DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY:

  107.   THIS PROGRAM IS PROVIDED "AS IS".  MAGORUM PRAEDA INTERACTIVE, INC.
  108.   MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, EITHER EXPRESS OR
  109.   IMPLIED, WITH RESPECT TO THIS PROGRAM OR ANY FILES, DOCUMENTATION OR
  110.   ELEMENTS THEREOF OR RELATING THERETO OR ANY MEDIUM THE PROGRAM MAY
  111.   BE ON (INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY
  112.   OR OF FITNESS FOR A PARTICULAR PURPOSE OR OF QUALITY OR PERFORMANCE).

  114.   IN NO EVENT WILL MAGORUM PRAEDA INTERACTIVE, INC. BE LIABLE FOR
  115.   DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE
  116.   DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE PROGRAM OR
  117.   ANY FILES, DOCUMENTATION OR ELEMENTS THEREOF.

  120.   If any provision of this License Agreement is held to be void, invalid
  121.   or unenforceable, it will not affect the validity of the balance of
  122.   this Agreement, which shall remain valid and enforceable according to
  123.   its terms and conditions.
