  5. OBJECTIVE VOICE EMAIL FOR WINDOWS (TM) EVALUATION LICENSE AGREEMENT

  7. In the following license agreement the term "the Software"
  8. refers to Objective Voice EMail for Windows (tm). 
  9.  
  10. By using this software you agree to the following:
  11.  
  12. 1.  Evaluation Period.  This evaluation license is good only for the
  13. length of the evaluation period. The evaluation period runs for
  14. either 60 days or the time you receive the first message from the
  15. software indicating that your evaluation period has expired, 
  16. whichever comes first. If you chose to use this program after the
  17. expiration date you need to purchase a license from Objective Voice.
  18.  
  19. 2.  Extended Use. Individual.  To use Objective Voice EMail for
  20. Windows (TM) after the evaluation period has expired, you need
  21. to purchase an Individual license.  An Individual license is required
  22. for each machine on which this software will run. For more information
  23. on how to obtain an Individual license contact Objective Voice at

  27. 3.  SITE License.  To use Objective Voice Email for Windows (TM) in a
  28. commercial, educational or governmental agency on more than one
  29. computer, a SITE LICENSE option is available.  The Site License allows
  30. the organization to use the software package on up to the number of
  31. computers licensed.  Site License fees are based on the total number
  32. of computers that will use the softwarepackage.  For more information

  37. 4.  Restrictions.  Objective Voice Email for Windows (TM) is
  38. copyrighted and title to all copies is retained by Objective Voice
  39. and/or its licensors. Unless enforcement of this provision is
  40. prohibited by applicable law, Licensee shall not modify, decompile,
  41. disassemble, decrypt, extract, or otherwise reverse engineer Software.
  42. Software may not be transferred, leased, assigned, or sublicensed,
  43. in whole or in part.  No right, title or interest in and to any
  44. trademarks or trade names of Objective Voice or Objective Voice's
  45. licensors is granted hereunder. Software is not designed or intended
  46. for use in on-line control of aircraft, air traffic, aircraft
  47. navigation or aircraft communications; or in the design, construction,
  48. operation or maintenance of any nuclear facility.

  50. 5.  Confidentiality.  Objective Voice EMail for Windows (TM) is
  51. confidential and proprietary information of Objective Voice and/or its
  52. licensors. Licensee agrees to take adequate steps to protect Software
  53. from unauthorized disclosure or use.  
  54.  
  55. 6.  Disclaimer of Warranty.  The Software is provided "AS IS,"
  56. without a warranty of any kind.  ALL EXPRESS OR IMPLIED
  57. REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY
  58. OF MERCHANT- ABILITY, FITNESS FOR A PARTICULAR PURPOSE OR
  59. NON-INFRINGEMENT, ARE HEREBY EXCLUDED.

  61. 7.  Limitation of Liability.  IN NO EVENT WILL OBJECTIVE VOICE
  62. BE LIABLE FOR ANY LOST REVENUE, PROFIT OR DATA,  OR FOR DIRECT,
  63. INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES
  64. HOWEVER CAUSED AND REGARDLESS OF THEORY OF LIABILITY ARISING OUT
  65. OF THE USE OF OR INABILITY TO USE  SOFTWARE, EVEN IF OBJECTIVE
  66. VOICE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  68. In no event shall Objective Voice's total liability to you for all
  69. damages, losses, and causes of action (whether in contract, tort
  70. (including negligence), or otherwise) exceed the amount paid by you
  71. for Objective Voice EMail for Windows (tm).
  72.  
  73. 8.  Termination.  Licensee may terminate this License at any time by
  74. destroying all copies of Software including any documentation.  This
  75. License will terminate immediately without notice from Objective
  76. Voice if Licensee fails to comply with any provision of this License.
  77. Upon termination, Licensee must destroy all copies of Software.  
  78.  
  79. 9.  Export Regulations.  Objective Voice EMail for Windows (TM),
  80. including technical data, is subject to U.S. export control laws,
  81. including the U.S. Export Administration Act and its associated
  82. regulations, and may be subject to export or import regulations in
  83. other countries.  Licensee agrees to comply strictly with all such
  84. regulations and acknowledges that it has the responsibility to obtain
  85. licenses to export, re-export, or import Software.
