  5. PLEASE READ THIS LICENSE AGREEMENT CAREFULLY BEFORE LOADING OR RUNNING THIS
  6. SOFTWARE.  BY USING THIS SOFTWARE YOU AGREE TO ACCEPT AND BE BOUND BY THE
  7. TERMS OF THIS LICENSE.  IF YOU DO NOT ACCEPT THE TERMS OF THIS LICENSE, DO
  8. NOT USE THIS SOFTWARE.

  10.      This software and documentation is the property of Command Corp. Inc.
  11. and is intended for private use as a demonstration of Command Corp. Inc.'s
  12. product IN3 Voice Command.  This software and documentation is NOT FOR
  13. RESALE.
  14.  
  15.      The software and documentation (the "Product") is licensed to you for
  16. use under the following conditions.

  18. PERMITTED USES / You MAY:

  20.      Use the Product on a PC.
  21.  
  22.      Make copies as you wish provided you do not alter the software or
  23. documentation in any way.

  25.      This Product is protected by copyright law.  As an express condition
  26. of this License, if you produce copies of the Product, you must reproduce
  27. on each copy the Command Corp. Inc. copyright notice and any other
  28. proprietary legends that were on the original copy supplied by Command
  29. Corp. Inc.

  32. PROHIBITED USES / You MAY NOT:

  34.      Distribute, rent, sublicense, lease, resell or assign the Product or
  35. this Agreement.

  37.      Alter, modify, disassemble, reverse engineer, or adapt the Product,
  38. including but not limited to, translating or creating derivative works.
  39.  
  40.      Transfer the Product or this License without the prior written consent
  41. of Command Corp. Inc.
  42.  
  43.      Export or re-export the Product without the appropriate United States
  44. or foreign government licenses or approvals.
  45.  
  46.      Except as specifically provided above, Command Corp. Inc. MAKES NO
  47. WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THIS
  48. PRODUCT, INCLUDING QUALITY, PERFORMANCE, MERCHANTABILITY, FITNESS FOR A
  49. PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THE RIGHTS OF THIRD PARTIES.  The
  50. warranty and remedies set forth above are exclusive and in lieu of all
  51. others, oral or written, express or implied.  No dealer, distributor,
  52. agent, or employee is authorized to make any modification or addition to
  53. this warranty.

  55.      IN NO EVENT, WILL COMMAND CORP. INC. BE LIABLE FOR ANY DIRECT,
  56. INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE
  57. USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY
  58. OF SUCH DAMAGES.  SPECIFICALLY, COMMAND CORP. INC. IS NOT RESPONSIBLE FOR
  59. ANY COSTS INCLUDING, BUT NOT LIMITED TO, THOSE INCURRED AS A RESULT OF LOST
  60. PROFITS OR REVENUE, LOSS OF USE OF THE PRODUCT, LOSS OF DATA, THE COSTS OF
  61. RECOVERING SUCH SOFTWARE OR DATA, THE COSTS OF SUBSTITUTE SOFTWARE OR DATA,
  62. CLAIMS BY THIRD PARTIES, OR FOR OTHER SIMILAR COSTS.  IN NO CASE SHALL THE
  63. LIABILITY OF COMMAND CORP. INC. EXCEED THE AMOUNT OF THE LICENSE FEE.

  65.      Some states do not allow the exclusion or limitation of implied
  66. warranties or limitation of liability for incidental or consequential
  67. damages, so the above limitation or exclusion may not apply to you.

  69. GENERAL
  70.  
  71.      Command Corp. Inc. retains all rights not expressly granted.  This
  72. license will be construed under the laws of the State of Georgia, except
  73. for that body of law dealing with conflicts of law.  If any provision of
  74. the License shall be held by a court of competent jurisdiction to be
  75. contrary to law, that provision will be enforced to the maximum extent
  76. permissible and the remaining provision of this License will remain in full
  77. force and effect.
