  21. if both were too drunk to be coherent, then if one of the persons initiated
  22. and carried out some act which, if done without consent, si considered
  23. rape, then it is rape.  if both particpated equally in making the event
  24. happen, it is not rape.

  26. it is analogous to the following situation: if you drive a car, and run over
  27. a drunk pedestrian, it is your fault.  if you get drunk and drive a car
  28. while drunk, and run over a drunk pedestrian, it is still your fault.
