- I think that might be stretching the definition of emergency. Travelling
- in excess of 85 mph by itself is not significantly more life threatening
- than travelling at 55 mph. It may be for the public good, but a life
- threatening situation? If you considered it an emergency situation, then
- do you suggest that an amateur with out-of-band transmit capabilities call
- the local police department on police frequencies if the amateur spots
- someone they feel is driving under the influence? I certainly wouldn't
- want to defend and of those actions to the FCC if they issued an Notice of
- Apparent Liability.

- If he can't respond, it is broadcasting. If the driver is not a licensed
- amateur, it is communication with a non-amateur radio station. Both of
- which are explicitly prohibited under Part 95.
