-
- I don't know about OSHA compliance per se, but I do know a little bit about
- mutual aid agreements and liability.
-
- Background: Our volunteer department is in Boulder County in Colorado.
- Rather than signing mutual aid agreements with every other department
- in the county, the county came up with one true mutual aid agreement
- that each department signs once, and it subsequently agrees to respond
- to any other department requesting mutual aid from them.
-
- The Fine Print: Apparently, CRS (Colorado Revised Statutes) dictate
- that if the Responding Department commits a tortious act (Does a Bad
- Thing) while providing mutual aid at the request of the Requesting
- Department, the Requesting Department is liable for dammages. However,
- our particular mutual aid agreement specifically calls this out and
- supercedes it by saying that in this situation, the Responding
- Department will indemnify and hold harmless the Requesting Department
- (the Responding Department is liable for damages).
-
- What It Means: OUR PARTICULAR AGREEMENT is set up that the Responding
- Department must cover it's own ass. YOUR ACTUAL MILEAGE MAY VARY, and
- it's worth checking into, especially if you have a dictionary of common
- legal terms on hand. My intuition tells me that the CRS is probably
- pretty close to uniform code, and your state's law may therefore be
- similar. Even so, be mindful of any mutual aid agreements that may
- supercede local or state law.
