- Yes it is. Unfortunately, there is not objective way to quantify
- maturity, or advancement of physical puberty, or what ever else you might
- want to use to judge someone's ability to give consent. There is an
- age at which children do not think of sex and do not welcome sexual
- activities. There comes an age where this changes. The age is different
- for every person. You can't define it quantitatively. Since we live in
- an imperfect world and an imperfect society, we choose age as the determinant.
- 12 is not a reasonable age since many childre are pre-pubescent at that
- age and cannot/would not consent to sex.

- There is a big problem here. Place this view into a real life setting.
- An adult has sex with a nine year old. The nine year old is scared.
- The adult says "you really want to do this don't you?" The child knows
- the adult is powerful and doesn't know how to handle the situation.
- He/she says "I guess so..." and whimpers. Later, the attorney for the
- adult puts the child on the stand and demands to know "did you consent?"
- "What does that mean" asks the child. "Did you tell him/her it was okay?".
- "Yes" replies the child. Case is closed. This child did not have the
- capacity to deny consent. Children are immature and are manipulated
- by adults all the time. It is, and should be, against the law to
- manipulate and exploit children in this particular way. In an imperfect
- world, age is the very best way to define the law, in my opinion. Of
- course, pedophiles will argue to the death why this view is wrong, but
- we know why they do this, don't we?
