  24. Investigators from the House of Representatives have found the 
  25. Rockwell International-operated nuclear bomb plant at Rocky 
  26. Flats, Colo., the Department of Energy which owns the plant, and 
  27. the Justice Department which "quashed prosecution" of top 
  28. Rockwell executives all responsible for committing and covering 
  29. up horrendous environmental crimes.

  31. The congressional action was taken after pressure from members of
  32. a grand jury looking into the case. Then in November, the jurors 
  33. wrote to President-elect Clinton demanding an investigation of 
  34. the Justice Department's leniency in convictions against 
  35. Rockwell. The grand jury carried out its own year-long 
  36. investigation of the plant after being outraged at a plea bargain
  37. that let Rockwell and DOE officials off with only 10 violations 
  38. and fines of $18.5 million. Does that sound like a lot of money? 
  39. It will cost taxpayers more than $1 billion--50 times as much--to
  40. clean up Rocky Flats.

  42. The grand jurors found that for 40 years Rockwell operated one of
  43. the nation's most polluted sites, poisoning the environment with 
  44. massive doses of plutonium, tritium and other radioactive toxins.
  45. They illegally stored, treated and disposed of hazardous 
  46. radioactive waste. The company dished out millions of dollars in 
  47. bonuses to government and corporate employees, carrying on a 
  48. secret campaign of coverups in the name of national security.

  50. According to the House investigation, dozens of Justice 
  51. Department aides let Rockwell avoid "millions of dollars in fines
  52. and additional convictions against the corporation and some 
  53. executives." Investigators reported the DOE "actively 
  54. participated in and directed a conscious and ongoing effort to 
  55. evade the application of certain environmental laws to the plant 
  56. ... hiding behind the sovereign immunity of the U.S. government."

  58. In the congressional report, the Justice Department was fingered 
  59. for blocking the release of the grand jury's investigation and 
  60. for covering up an agreement with the company that they would not
  61. release any information if the jurors' investigation opened 
  62. Rockwell to civil suits.

  64. Rep. Howard Wolpe (D-Mich.) said federal "prosecutors had 
  65. evidence that poisons were spread into drinking water, in 
  66. violation of the Clean Water Act, but stopped pursuing evidence 
  67. and making charges so as to not jeopardize a negotiated 
  68. settlement." The congressional investigation found that lead 
  69. prosecutor Kenneth Fimber told the department to anticipate "a 
  70. barrage of inquiries" because "terrible substances" were getting 
  71. into the drinking water.

  73. To add insult to injury, Rockwell is billing the government for 
  74. $7.9 million in legal fees. Both it and the Justice Department 
  75. refuse to admit to any crimes.
